Resolution No. 29, Series 2020 <br />Page 2 of 3 <br />Electronic Participation and the agenda for such meeting shall be revised to reflect it will <br />be held by Electronic Participation. <br />B. Such measures shall be taken by the Appointed Body to ensure that: <br />1. Each such meeting is open to the public at all times, and information <br />is provided to enable Electronic Participation by the public; <br />2.Members of the Appointed Body can hear one another or otherwise <br />communicate with one another and can hear or read all discussion and testimony in a <br />manner designed to provide maximum notice and participation. <br />3.All votes are conducted by roll call; and <br />4.Each such meeting provides City staff and the public a reasonable <br />opportunity to be heard. <br />C. No public hearings on quasi-judicial matters and no votes on quasi-judicial <br />actions shall be taken by the Appointed Body during a meeting held by Electronic <br />Participation unless and until the City Council adopts a resolution establishing guidelines for <br />such matters that conform with the requirements of the City’s Home Rule Charter, the <br />Louisville Municipal Code, and constitutional due process requirements. Unless and until <br />such a resolution has been adopted by the City Council, any quasi-judicial matter scheduled <br />for a meeting of an Appointed Body held by Electronic Participation shall be continued by <br />motion of the Appointed Body to the date and time of the next regular or special meeting of <br />the Appointed Body to be held in person. If the Appointed Body is unable to determine when <br />the next in-person regular or special meeting will be held, quasi-judicial matters scheduled for <br />a meeting held by Electronic Participation shall be vacated and new public notice will be <br />provided when such quasi-judicial matters are rescheduled. <br />Section 4. Nothing in this resolution is intended to modify Section 5-18(a) of the City of <br />Louisville Home Rule Charter, which requires any meeting of an Appointed Body shall be preceded <br />by the posting of a notice of and the agenda for the meeting at least seventy-two (72) hours before the <br />meeting. <br />PASSED AND ADOPTED this 31st day of March, 2020. <br />_________________________________ <br />Ashley Stolzmann, Mayor
