Planning Commission <br />Meeting Minutes <br />June 23, 2016 <br />Page 8 of 30 <br />Rezoning should be approved if ANY of the following criteria are met. <br />LMC Section 17.44.050 — Rezoning Criteria: <br />1. The land to be rezoned was zoned in error and as presently zoned is inconsistent with the <br />policies and goals of the city's comprehensive plan; No evidence of error in zoning. It has been <br />zoned commercial for 40 years. Not met. <br />2.The area for which rezoning is requested has changed or is changing to such a degree that it <br />is in the public interest to encourage a redevelopment of the area; The applicant argues that we <br />are now seeing a lot of development in the CTC and demand for industrial flex space. Over the <br />40 years, we have seen no demand for commercial uses that the zoning calls for. When it was <br />zoned commercial, it was with the intent that this would be a fully developed industrial office <br />park to support ancillary commercial uses. We are near full build out to possibly support <br />commercial uses and demand for commercial use. Met. <br />3.The proposed rezoning is necessary in order to provide land for a community -related use <br />which was not anticipated at the time of the adoption of the city's comprehensive plan, and such <br />rezoning will be consistent with the policies and goals of the comprehensive plan; or There is no <br />specific proposed use for commercial to industrial and there is no evidence of civic use or <br />community use. Not met. <br />4.The rezoning would only permit development which, if evaluated as a proposed annexation <br />under the annexation standards and procedures codified in title 16, would qualify for annexation. <br />Met. <br />LMC Section 16.32.030 — Annexation: <br />
