Board of Adjustments and Appeals Appeal from an Administrative Decision May 6, 1987 Authority: Section 17.48.090 states, in part, that "Appeals to the board of adjustment concerning any order, requirement, decision or determination made by the zoning administrator charged with the enforcement of this title may be taken by persons aggrieved who are affected by any decision of the zoning administrator..." "The board may affirm, reverse, reverse wholly or partly, or modify the order, requirement, decision or determination appealed; ... and to that shall have end all powers that the officer from whom the appeal is taken." Facts: 1. 0n March 20, 1987, the Director of Community Development approved a minor amendment to the Westfield II Planned Unit Development. This amendment had the net effect of decreasing the distance, shown on the PUD, between Buildings #7 and #11 by approximately eight feet. 2. The authority for this decision is contained in Section 17.28.210 of the city code which states, in part: "No change may be made in an approved final plan during the construction of the PUD except upon application to the city under the procedures provided below: A. Minor changes in the location, siting and height of buildings and structures, and other minor changes may be authorized by the director of community development ... if said changes are required by engineering or other circumstances not foreseen at the time the final Planned Unit Development plan was approved.... B. All changes in use, density or the outline development plan must be approved by the planning commission and the city council... All other changes in the arrangement of lots, blocks and buildings, any changes in the provision of common open spaces, and all other changes in the approved final plan, except those which are minor changes 1
