Board of Adjustments and Appeals <br />Appeal from an Administrative Decision <br />May 6, 1987 <br />Authority: <br />Section 17.48.090 states, in part, that "Appeals to the <br />board of adjustment concerning any order, requirement, <br />decision or determination made by the zoning <br />administrator charged with the enforcement of this <br />title may be taken by persons aggrieved who are <br />affected by any decision of the zoning <br />administrator..." <br />"The board may affirm, reverse, reverse wholly or <br />partly, or modify the order, requirement, decision or <br />determination appealed; ... and to that shall have end <br />all powers that the officer from whom the appeal is <br />taken." <br />Facts: <br />1. 0n March 20, 1987, the Director of Community <br />Development approved a minor amendment to the Westfield <br />II Planned Unit Development. This amendment had the <br />net effect of decreasing the distance, shown on the <br />PUD, between Buildings #7 and #11 by approximately <br />eight feet. <br />2. The authority for this decision is contained in Section <br />17.28.210 of the city code which states, in part: <br />"No change may be made in an approved final plan during <br />the construction of the PUD except upon application to <br />the city under the procedures provided below: <br />A. Minor changes in the location, siting and height <br />of buildings and structures, and other minor <br />changes may be authorized by the director of <br />community development ... if said changes are <br />required by engineering or other circumstances not <br />foreseen at the time the final Planned Unit <br />Development plan was approved.... <br />B. All changes in use, density or the outline <br />development plan must be approved by the planning <br />commission and the city council... All other <br />changes in the arrangement of lots, blocks and <br />buildings, any changes in the provision of common <br />open spaces, and all other changes in the approved <br />final plan, except those which are minor changes <br />1 <br />
