<br />Planning Commission <br />Meeting Minutes <br />August 14, 2008 <br />Page 6 of 11 <br /> <br />Commission Questions: <br />Tengler asked if Condition #4 from Resolution No. 38, Series 2007 is standard or if this <br />is specific to Waterloo. <br /> <br />Wood stated the condition is standard for all downtown businesses to provide off-street <br />parking for their employees. <br /> <br />Applicant Presentation: <br />Josh Karp, 630 West Sandbar Circle, Louisville, stated that 25% of his sales are <br />generated from the patio. He stated his willingness to add more sound mitigation if <br />needed. <br /> <br />Members of the Public: <br />David Hatch, 733 Pine St., Louisville, CO stated he supports the current hours of <br />operation of the patio dining because of the potential for additional noise for those <br />residences that back to the property. <br /> <br />Amy Moore, 808 Lafarge, Louisville, CO stated that she and Sonja are both employed <br />by the airline industry. They had moved the Louisville for the convenience and the <br />walkability of the Old Town area. She requested permission to playa sound wave <br />recording that represents what they hear on a regular basis. <br /> <br />Wood advised the Commission that Staff had learned earlier in the day that the <br />recording is not an actual recording of the noise from the subject property but is strictly <br />a simulation. <br /> <br />Lipton requested the recording not be played. <br /> <br />Hartman asked Moore how the noise level had been. <br /> <br />Moore replied it is evident but knowing that it will end at 10:00 p.m. helps. <br /> <br />Pritchard asked how long she had lived at the current location on Lafarge. <br /> <br />Moore stated 2 % years. <br /> <br />Garrett Mundelein, 555 County Road, Louisville, CO stated he walks his dog late a night <br />and the route generally includes the alley behind Waterloo. Based on his experience the <br />extended hours will not impact the noise level. He stated the SRU can always be <br />revoked if the City receives complaints. <br /> <br />Jeremiah Whittney, 804 Walnut, Louisville, CO stated he does not hear any <br />objectionable noise from the patio area. <br /> <br />Commission Questions to Staff and Applicant: <br /> <br />Tengler asked Karp if he was willing to accept the conditions as presented. <br /> <br />Karp stated he was. He also stated that the cars leaving the back of the patio after <br />closing is probably noisier than anything coming from the patio. He also stated his <br />willing to add noise dampening devices. <br /> <br />Tengler asked Wood why the 11 :00 to midnight limited hours of operation. <br /> <br />Wood stated is the based on LMC 9.24(B)(4). <br /> <br />Sheets asked how the Commission would recall a SRU. <br />
