<br />Planning Commission <br />Meeting Minutes <br />August 14, 2008 <br />Page 7 of 11 <br /> <br />Wood stated they Commission would request the recall during a regular public hearing <br />meeting, directing staff to notify the applicant and then proceed with all the necessary <br />steps to publish the recall of a special review use. <br /> <br />Lipton discussed parking requirements with staff as well as the possible parking in lieu <br />fee. <br /> <br />Wood stated the on site parking is to be used for parking and not storage, which is how <br />the area is being used at this time. He also stated the parking-in-lieu fee is only for new <br />businesses and not established businesses such a Waterloo. <br /> <br />Sheets asked about the parking at Huckleberry. <br /> <br />Wood stated there are 4 spaces next to the alley for employee parking. The addition of <br />the outside dining might have changed the number of spaces because of the double <br />stacking that sometime occurred. <br /> <br />Staff and Applicant Summarv and Recommendation: <br />Karp had no additional comments. <br /> <br />Wood stated that staff recommends the approval of the SRU with the conditions from <br />Resolution No. 38, Series 2007 being carried forward to the new Resolution No. 14, <br />Series 2008. <br /> <br />Public Hearinq Closed Commission Comments: <br />Hartman stated she does not support the extended hours as requested by the applicant <br />but does support staff's recommendation. <br /> <br />Russell stated his agreement with Hartman and staff. He also wants the neighbors to <br />know that as a Commissioner he is not discounting their comments and if they ever <br />have any problems they should contact the Planning Department immediately. <br /> <br />Loa stated she had originally voted against the SRU in 2007. However, she is <br />supporting the request as presented by staff and appreciates the business that <br />Waterloo is bringing to downtown Louisville. <br /> <br />Lipton discussed additional sound proofing. <br /> <br />Pritchard stated his support of the extended hours for the dining patio as presented by <br />staff. <br /> <br />Tengler stated his support of the extended hours. He also commented the noise inside <br />is greater then any noise on the back patio. He suggested removing Condition #2 <br />regarding the parking and adding a condition to address the addition of sound proofing. <br /> <br />Sheets stated her support of the resolution as presented by staff. She also supports the <br />removal of Condition #2 (Parking). <br /> <br />Loa asked if a parking agreement letter to the city should be used in place of the <br />condition. <br /> <br />Russell stated the use of the parking area for storage is a violation of the municipal <br />code. <br /> <br />Wood stated the applicant must provide off-street parking spaces for employees. The <br />spaces can not be used for storage. <br />
