ORDINANCE NO. 1806, SERIES 2021 — AN ORDINANCE APPROVING THE VACATION OF A 53.56-FOOT LONG PORTION OF A 5-FOOT WIDE UTILITY EASEMENT ON LOTS 22, 23, AND 24, EXCEPT THE EAST THREE AND ONE-HALF FEET OF LOT 22, BLOCK 6, JEFFERSON PLACE (701 PINE STREET) — 2ND READING —PUBLIC HEARING (advertised Daily Camera 4/15/21) Mayor Stolzmann introduced the item and asked for any disclosures. There were no disclosures. She noted additional comments were submitted via email and those have been posted online as part of the packet addendum. Mayor Stolzmann opened the public hearing. Planner Hassan reviewed the lot and history of the property. In 2006, City Council approved Ordinance 1845, Series 2006, which vacated a 10-foot wide, 125-foot long alleyway north of the property and distributed the land evenly between 701 Pine Street and Lot 19 to the north, creating two 5-foot-wide easements. Per the Ordinance, the easements were reserved "for the operation, maintenance, repair and replacement of existing and future public utilities." In 2020, a building permit was submitted for a new single family home with a detached garage on this site. The owners would like to place a portion of their detached garage in this 5-foot easement. The applicant requests the vacation of a 53.56-foot long, 5-foot wide portion of the easement, approximately 268 square feet. This portion would span through lots 23 and 24, and part of lot 22. The remaining 20-foot portion would be used for existing utilities, including electric and sewer service.
