Commercial Community (C-C) zone district which is bounded on the north by <br />South Street; on the south by the south line of the Town of Louisville Subdivision; <br />on the west by the alley between Main Street and LaFarge Avenue; and on the east <br />by the Burlington Northern Santa Fe Railroad tracks; and (2) all of that certain <br />Commercial Business (C-B) zone district set forth on the official zoning district map <br />of the City and bounded on the north by the south line of the Town of Louisville <br />Subdivision; on the south by the north line of the Mansour-Engel Subdivision; on <br />the west by the right-of-way for County Road/Front Street; and on the east by the <br />Burlington Northern Santa Fe Railroad Tracks. <br /> <br /> Section 2. Chapter 17.12 of the Louisville Municipal Code is hereby amended by the <br />addition of a new section 17.12.060 to read as follows: <br /> <br /> 17.12.060 Maximum Floor Area - Westerly Portion of Downtown Louisville <br /> Within the area designated as the Westerly Portion of Downtown Louisville, as <br /> defined in Chapter 17.08, the maximum floor area shall be 354,000 square feet. No <br /> development shall be permitted within the Westerly Portion of Downtown Louisville once a <br /> maximum floor area of 354,000 square feet has been achieved within such area. To the <br /> extent that this section establishes a requirement which conflicts with a yard and bulk <br /> requirement set forth in any other applicable section of Title 17, the specific requirement of <br /> this section shall control. <br /> <br /> Section 3. All other ordinances or portions thereof inconsistent or conflicting with this <br />ordinance or any portion hereof are hereby repealed to the extent of such inconsistency or conflict. <br /> <br /> Section 4. If any portion of this ordinance is held to be invalid for any reason, such <br />decision Shall not affect the validity of the remaining portions of this ordinance. The City Council <br />hereby declares that it would have passed this ordinance and each part hereof irrespective of the fact <br />that any one part be declared invalid. <br /> <br /> Section 5. The repeal or modification of any provision of the Municipal Code of the <br />City of Louisville by this ordinance shall not release, extinguish, alter, modify, or change in whole <br />or in part any penalty, forfeiture, or liability, either civil or criminal, which shall have been incurred <br />under such provision, and each provision shall be treated and held as still remaining in force for the <br />purpose of sustaining any and all proper actions, suits, proceedings, and prosecutions for the <br />enforcement of the penalty, forfeiture, or liability, as well as for the purpose of sustaining any <br />judgment, decree, or order which can or may be rendered, entered, or made in such actions, suits, <br />proceedings, or prosecutions. <br /> <br /> Section 6. Any person who violates any provision of this Ordinance shall be punished <br />by a fine of not more than $1,000 or by imprisonment not to exceed 1 year or both such fine and <br />imprisonment. Each day during any portion of which any violation of any provision of this <br />ordinance is committed, continued, or permitted by any such person shall be a separate offense. <br /> <br /> <br />
