<br />PAGE TWO <br />SUBJECT: UPDATE/DISCUSSION BUILDING CODE BOARD OF APPEALS <br /> <br />DATE: MAY 26,2009 <br /> <br />RECOMMENDATION: Adoption of the Codes after the BCBOA completes a review, makes <br />amendments and presents an ordinance for the councils review. <br /> <br />ATTACHMENTS: None at this time <br /> <br />II. CHANGE BY LAWS OF BUILDING CODE BOARD OF APPEALS TO REFLECT <br />ADVISORY FUNCTION <br /> <br />OBJECTIVE: <br />To update the Building Code Board of Appeals (BCBOA) bylaws to reflect the actual advisory <br />function. <br /> <br />SUMMARY: <br /> <br />The BCBOA has historically served not only as decision making body to determine proper <br />interpretation of the building codes, but has also served as an advisory board to the Building <br />Safety Division and the Chief Building Official. There has been one Board of Appeals case in <br />the last eight years under the current leadership of the Planning / Building Division. The current <br />language in the BCBOA bylaws and in the Building Code, do not make provisions to allow for <br />the board to act in an advisory capacity. It is the desire of the Building Safety Division and the <br />Chief Building Official to have the bylaws updated so the BCBOA can act in an advisory role. <br />This advisory role would serve well for code adoptions, policy changes and specifically with the <br />research and adoption of a green building program or similar processes. The intent is to have <br />this completed this summer. <br /> <br />FISCAL IMPACT: <br />The only cost will be a legal review after the board has completed the rewrite. <br /> <br />RECOMM ENDA TION: <br />Acceptance of the new bylaws after the rewrite and legal review. <br /> <br />ATTACHMENT(S): None <br /> <br />20 <br />
