<br />10/4/83 <br /> <br />Page -9- <br /> <br />Councilman Cussen <br /> <br />Expressed dire concern that it is taking <br />so much time to get this issue resolved. <br />Suggested that the wording of the present <br />ordinances be reviewed to make enforcement <br />of them expediently. He wished to direct <br />the Director of Public Safety and the City <br />Attorney to review the ordinance and see <br />if it needed to be reworded to give it more <br />substance to be enforced, specifically with <br />a vehicle that has been parked on the street <br />for a year. <br />Attorney Rautenstraus advised that if a vehicle <br />has license plates it is normally not con- <br />sidered an abandoned vehicle. <br />Councilman Cussen commented that it was his <br />understanding that the vehicle did not have <br />an engine in it therefore would fit in the <br />disabled category as stated in the ordinance. <br /> <br />CITY ATTORNEY'S REPORT <br />ORDINANCE #808 - LOUISVILLE <br />ASSOCIATES RE-ZONING <br /> <br />Councilmembers had a copy of the ordinance <br />as well as information from the State Highway <br />Dept., HOH representatives and staff. <br />Attorney Rautenstraus stated Mayor and council- <br />members had received a letter from the appli- <br />cant requesting that this matter be delayed <br />for first reading at their next council meeting <br />of October 18, 1983. This is staff's recom- <br />mendation also. <br /> <br />Councilwoman Morris <br /> <br />Inquired why council was addressing this on <br />first reading prior to getting all of the <br />information submitted by November 2nd? <br /> <br />Joe French, Attorney Representing <br />Louisville Associates Advised that the dates stated in the letter <br />had emerged after discussion with the City <br />staff. They had a hearing before the Plan- <br />ning Commission and there were some concerns <br />expressed and they wished to get all the <br />information to councilmembers before the study <br />session. He felt that the only other informa- <br />tion would be with the P.U.D. Guidelines and <br />these are being reviewed with staff presently. <br />There were 6 items of concern which would be <br />dealt with and information provided to the <br />councilmembers before the study session. <br /> <br />Councilman Leary <br /> <br />Commented before the first reading of Ordinance <br />#808 he would like to have a study session <br />with the staff and the representatives of <br />Louisville Associates may be present if they <br />wished; he had several questions he wished <br />answered before first reading as this would <br />be the one presented for the public hearing. <br />
