<br />8/16/83 <br /> <br />Page -10- <br /> <br />Councilman Leary <br /> <br />Commented the suggestion of Director Rupp <br />was in the instance of a developing area <br />i.e. CTC, if a company came in and it was <br />very compatible with that company to have <br />a child care center, then another person <br />comes in and wishes to build it may not be <br />compatible with a child care center but <br />would be able to do it. <br /> <br />Director Rupp <br /> <br />Stated that was correct. In reviewing the <br />industrial zones and uses, there are certain <br />use by rights that an industrial user might <br />say that he was being precluded from that use <br />by right because of this other situation. <br />Leary inquired if a Special Review Use can be <br />withdrawn at any time? <br /> <br />Attorney Rautenstraus <br /> <br />Advised there would have to be very strict <br />criteria because there would be one party <br />relying on Council's approval - spending <br />money - building something and then if approval <br />was not given at a later date there would be <br />problems. <br /> <br />,icensing <br /> <br />Leary inquired what about licensing by Social <br />Services - when they renew a license do they <br />look at the neighboring area? <br />Rautenstraus remarked he was not certain of <br />the license renewal process - they reviewed <br />mainly the facility and the applicant's ability, <br />unless there was a major problem. <br />Leary then inquired what the classification <br />would be if a company wished to open a child <br />care center and it would have 50 children in it. <br /> <br />Mayor Meier <br /> <br />Commented he felt that a Special Review Use <br />should be permitted in the Office Zone cate- <br />gory but did not favor this for the Industrial <br />Zone. Remarked even when there is an existing <br />company who decided to build a child care cen- <br />ter then would later sell the building and <br />the next use maybe determental to the child <br />care center. <br /> <br />Attorney Rautenstraus advised that STC could <br />have some type of child care within their <br />own facility if it met the criteria for an <br />accessory use. But a separate entity could <br />not come into the STC area now in an Industrial <br />Zone and put in either a neighborhood child <br />care center or a regular child care center. <br />
