<br />4/19/83 <br /> <br />Page -9- <br /> <br />Councilman Cummings <br /> <br />Concurred with Councilwoman Morris' comments; <br />stated however since a policy has not been <br />established and the current policy requirement <br />states that if the applicant meets conditions <br />he is entitled to a public hearing. Reiter- <br />ated this was the applicant's legal right. <br /> <br />Inquired of the City Attorney if council was <br />obligated to pass Ordinance #791 legally on <br />first reading. <br />Attorney Rautenstraus stated council did not <br />have to pass it; but would feel more comfort- <br />able if a public hearing would be held. Felt <br />it would be a more defensible position to not <br />adopt the ordinance after the public hearing. <br /> <br />Councilman Leary <br /> <br />Councilman Leary commented that he felt we <br />have more obligation to our residents than <br />anyone that is not part of the City at this <br />time. Also felt that the main issue was <br />whether we wanted to honor the will of the <br />people. Didn't think there was any question <br />about it; was surprised that any councilman <br />after these people conducted the survey the <br />first time suggested they had to have more <br />names. He thought it was valid so he called <br />a person who has some field in statistics <br />and explained what they had done and he told <br />him that if they went to the rest of the City <br />they would get the same results. They did <br />this and got the same result. He pleaded with <br />at least one more person on the council to <br />value the will of the people over the other <br />special interests and vote in favor of the <br />motion. <br /> <br />Councilman Cussen <br /> <br />Remarked he understood that council would <br />be meeting with the Homart people the last <br />week of April and felt it was cruical that <br />council know what Homart is going to do; and <br />continue to do the discussed planning with <br />reaffirmation. Felt that a public hearing <br />should be held, but not until these 5 areas <br />of concern have been addressed. Was also <br />concerned about fiscal planning and how that <br />would impact the City; therefore would support <br />the motion. <br /> <br />Councilman Fauson <br /> <br />Concurred with the comments regarding the <br />areas of concern and a policy needed to be <br />set for them. However, did not feel delaying <br />this annexation would solve the problems. <br />Suggested perhaps a limitation be placed on <br />
