Question called for. <br />All in favor. Motion carried unanimously. <br /> <br />Inquired if there was a way residents of <br />Louisville could be notified or have a means <br />of finding out 'when the City is drawing water <br />out of the Community Ditch. After reading <br />the articles in the paper regarding the leachate <br />at the Marshall Lake Landfill, he expressed <br />genuine concern and felt that people could <br />be given the opportunity to go to a different <br />source for drinking water. He realized that <br />the City did not use the Community Ditch all <br />year for its primary source. <br />Adminis.trator Wurl advised notification would <br />be possible in a general sort of time-frame. <br />No water is drawn from the Community Ditch <br />from October 1st until June 1st. Wurl ad- <br />vised he would review the records to be <br />more specific. <br /> <br />Commented he too would like to know what the <br />status was of installing a pipeline to avoid <br />the leachate problem. He also felt that there <br />were a lot of concerned residents in the City <br />relative to the leachate and most of them were <br />made aware of the situation by the newspaper <br />articles. <br /> <br />Wished to make a few remarks regarding the <br />Declaratory Judgement. As president of the <br />Mesa Improvement Corporation, he wished to <br />offer Council the following resolution. <br />Primarily if Council decides to vote yes for <br />the Declaratory Judgement Mcrc would resolve <br />to terminate all current legal activity in <br />this matter. Furthermore, MCIC is resolved to <br />abide by the decision of the declaratory judge- <br />ment and not to pursue additional legal acti- <br />vity thereafter. <br /> <br />Commented that Mr. Gauss did not get a response <br />to his question. <br />Administrator Wurl advised he would prefer to <br />draft a statement relating to the Community <br />Ditch giving specific dates and tests of <br />what was found. He further commented the <br />Denver Post article was extremely misleading, <br />and felt that the Louisville Times gave a general <br />
