Councilman Leary

Mayor Meier

CITY ATTORNEY'S REPORT
ORDINANCE #767 - VIDEO
GAMES - PUBLIC HEARING

Mrs. Carol Kelly - Co-owner
Pinball Wizard
In Opposition

11/3/82

Page -3-

outline of the history of the leachate problem.
This will be done either through the Louisville
Times or sent to the residents.

Requested this report be placed on the agenda
for the next council meeting thus allowing
people to ask further questions and council
discussion.

Advised if councilmembers wished further
information on the leachate problem, it was
available from staff.

Attorney Rautenstraus read the ordinance by
title only on second reading and public hearing;
also certified proper publication.

Mayor Meier opened the public hearing and
Attorney Rautenstraus advised that notice of
the public hearing was published in the
Louisville Times October 13, 1982. Rautenstraus
also advised that amendments to the ordinance
on first reading had been published.
Mayor Meier asked if there was anyone in favor
of the ordinance. None.
Anyone in opposition to the ordinance.
Stated the fee of $100.00 per machine is
excessive and that she had provided copies of
her profit and loss statement to councilmembers.
She suggested a fee of $25.00 per machine as
more feasible. Stated that her husband has
been ill and in the hospital requiring her to
hire addtional help, which again cut into the
profits. This is their only source of income.
~he range or revnue realized from each machine
was from $25.00 - $85.00 per week. The machines
are enjoyed by families, young adults and resi-
dents of the City. It was her opin'ion that
machines in bars and grocery stores perhaps
did realize revenue of $350.00 per week, per
machine and most of them did not have to pay
rent nor utilities. She commented the $700.00
she would be required to pay by ordinance could
be used for remodeling or buying bike racks, etc.
She requested that councilmembers please con-
sider amending the ordinance to reduce the
fees - had no problem with the rest of the
ordinance.
