L~FERRAL TO PLANNING COMMISSION TRACK INN - REQUEST TO ALTER PREMISES APPROVAL PASQUALE'S - LIQUOR LICENSE RENEWAL APPROVAL 7/6/82 Page -2- Discussion by Council regarding the waiving of the application fees for annexation. Director Rupp advised in Harch of 1980 when the City requested the County's annex- ation as an enclave an agreement was made the fees would be waived only if the zoning remained agricultural. At that time they were advised if they wished zoning other than agricultural, they would have to file a petition requesting different zoning. Attorney Rautenstraus advised in his opinion the applicant should be made known that the fees have not been waived and would be decided at the time the Annexation Agreement was ap- proved. It was his feeling that unless Council knew ~TIat zoning would be requested and what type of development of the property was being proposed, it would be difficult to make a decision on waiving the fees. Councilmembers generally agreed to refer the request to Planning Commission but not make a decision pertinent to waiving the fees. Councilman Fa.uson moved, Councilman Ferrera seconded that the Boulder County Annexation Request be referred to Planning Commission for review and recommendation. Question called for. All in favor. Motion carried unanimously. Attorney Rautenstraus advised that the application was in order and there was no need for a public hearing; as part of the applicant's liquor license they were requesting to alter the premises of the liquor license and had provided the correct documentation including a plan. Previously the Special RE~view Use and plan had been approved by Council. Councilman Cummings moved, Councilman Fauson seconded the Track Inn's request to alter premises be approved. Question called for. All in favor. Motion carried unanimously. Attorney Rautenstraus advised that the appli- cation was in order, and there were no police reports for the year. Councilwoman Morris moved, Councilman Leary seconded that Pasquale's Liquor License be renewed. Question called for. All in favor. Motion carried unanimously.
