<br />L~FERRAL TO PLANNING COMMISSION <br /> <br />TRACK INN - REQUEST TO ALTER <br />PREMISES <br /> <br />APPROVAL <br /> <br />PASQUALE'S - LIQUOR LICENSE <br />RENEWAL <br /> <br />APPROVAL <br /> <br />7/6/82 <br /> <br />Page -2- <br /> <br />Discussion by Council regarding the waiving <br />of the application fees for annexation. <br />Director Rupp advised in Harch of 1980 <br />when the City requested the County's annex- <br />ation as an enclave an agreement was made <br />the fees would be waived only if the zoning <br />remained agricultural. At that time they <br />were advised if they wished zoning other <br />than agricultural, they would have to <br />file a petition requesting different zoning. <br />Attorney Rautenstraus advised in his opinion <br />the applicant should be made known that the <br />fees have not been waived and would be decided <br />at the time the Annexation Agreement was ap- <br />proved. It was his feeling that unless <br />Council knew ~TIat zoning would be requested <br />and what type of development of the property <br />was being proposed, it would be difficult <br />to make a decision on waiving the fees. <br />Councilmembers generally agreed to refer <br />the request to Planning Commission but not <br />make a decision pertinent to waiving the fees. <br /> <br />Councilman Fa.uson moved, Councilman Ferrera <br />seconded that the Boulder County Annexation <br />Request be referred to Planning Commission <br />for review and recommendation. Question <br />called for. All in favor. Motion carried <br />unanimously. <br /> <br />Attorney Rautenstraus advised that the <br />application was in order and there was no <br />need for a public hearing; as part of <br />the applicant's liquor license they were <br />requesting to alter the premises of the <br />liquor license and had provided the correct <br />documentation including a plan. Previously <br />the Special RE~view Use and plan had been <br />approved by Council. <br /> <br />Councilman Cummings moved, Councilman Fauson <br />seconded the Track Inn's request to alter <br />premises be approved. Question called for. <br />All in favor. Motion carried unanimously. <br /> <br />Attorney Rautenstraus advised that the appli- <br />cation was in order, and there were no <br />police reports for the year. <br /> <br />Councilwoman Morris moved, Councilman Leary <br />seconded that Pasquale's Liquor License be <br />renewed. Question called for. All in favor. <br />Motion carried unanimously. <br />
