1/19/82 Page -6- on this annexation request on December 15, 1981 - two concerns were expressed - one was the Interchange issue and DRCOG's approval of the extension of the City's urban services area. Both these issues have since been resolved. He stated we on the City Council has supported the idea that government should involve the people therefore this annexation request should be brought to a vote of the people. COUNCILMAN CUSSEN Stated since he was the only one who spoke against the annexation request at the December 15, 1981 public hearing, he had received several calls supporting his concern of proper procedure to insure the integrity of the comp plan. By not following proper procedure a precedent could be set for future development by homeowners in the area. He defended the 1500' setback requirement of open space agreed on in the Centennial Valley Mall agreement, and questioned the urgency and zoning of the ordinance at this time, since ~r. Biella had no present plans. He supported staff reconunendations that the area was over zoned conunercially. He was sensitive to Hr. Biella, but felt he should go through the amended comp plan procedure. He referred to Resolution 4fr6 which was being presented this evening which says that Council is sensitive to property owners and they need to define a policy regarding open space. He was bothered by Hr. Biella's conunent, and felt council was being held hostage - if the ordinance did not pass Mr. Biella would deny the City of Superior the right-of-way through his property for the sewer line. COUNCILWOMAN MORRIS Stated her main concern was with procedure and the integrity of the comprehensive plan. She supported staff reconunendations that the annexation request was premature; that council does have to define open space policy and when these have been accomplished and Mr. Biella resubmits his requests for annexation council would reconsider.
