COUNCILI1AN C~1INGS COUNCILMAN FERRERA COUNCILMAN LEARY ORDINANCE #746 - REPEALED BIELLA ANNEXATION RECESS A. & B. LIQUORS - LICENSE TRANSFER TO "THE LIQUOR STORE" APPROVAL HISTORICAL COMMISSION APPOINTMENTS 1/19/82 Page -7- Agreed with Councilman Leary's comments regarding open space and the comp plan and supported them also; but felt that Mr. Biella presented his request before these procedures were adopted, and since the previous members of Council and Plan- ning Commission had adopted the ordinance, it should stand or go to a vote of the people. Also felt that Mr. Biella had followed pro- cedure outlined by staff available at that time, and felt this issue should go to a vote of the people. Commented there seemed to be confusion - there was procedure in the past to amend the comp plan - State statutes allow for amendments. Councilman Cussen moved, Councilman Leary seconded that Ordinance #746 - Biella Annex- ation be repealed by act of this City Council. Roll call vote: YES: Fauson, Cussen, Leary, Morris NO: Cummings, Ferrera Motion carried 4-2. Mayor Pro-tern Fauson called a 2 minute recess. Meeting resumed at 8:28 P.B. Attorney Rautenstraus advised the application for transfer was in order. Councilman Ferrera inquired of Director Rupp "..if the proposed new sign at the establish- ment met the sign code? Rupp replied this would be dealt with at a later date. Councilman Cussen moved, Councilman Cummings seconded that the license transfer from A.&B. Liquors to the The Liquor Store be approved. Question called for. All in favor. Motion carried unanimously. l1ayor Pro-tern Fauson advised these were the Hayor's appointments and in his absence directed Fauson to make the appointments of the following 4 people for a 4-year term.
