COUNCILI1AN LEARY

STORER CABLE TV

AUDIENCE COMMENTS

CITY ATTORNEY'S REPORT
ORDINANCE #751 - METZ ANNEX-
ATION PUBLIC HEARING

1/19/82

Page -8-

Inquired if the Historical Commission was
created by Resolution?
Administrator Wurl provided him with a copy
of the Resolution.

Councilwoman Norris requested copies of the
letters of interest of persons applying
for the Historical Commission.

Each member of council had a copy of a
letter submitted by Patricia Stahl stating
that the construction of the cable TV lines
had been completed; therefore met the
requirements of the agreement with the City.

None.

Attorney Rautenstraus read the ordinance
by title only on second reading - public
hearing and cE~rtified proper publication.

Mayor Pro-tern Fauson opened the public hearing
and called on Director Rupp for a presentation.
Rupp advised the property was located at
310 W. Spruce St., consisted of 8.7 acres,
and the zoning request was for 2.0 Acres
Residential Estate and 6.7 Acres Rural-
residential. If the property were to be
subdivided in the future the 6.7 RR zoning
would allow 13 units - 2.0 RE zoning would
allow 7 units. Pine Street does divide the
property and this has been deeded to the City
for its future east-west expansion. (Slides
were shown of the area and surrounding area.)
Rupp further advised that Mr. Robert Metz
had been relocated in another state and wished
to sell the property. The property is in
the City's urban service area and the zoning
is consistent with the comprehensive plan.
Planning Commission unanimously recommended
approval, as well as staff. The property
was an enclave of the City and contained
one residential dwelling. He provided each
council member with a signed annexation agree-
ment relative to the annexation request.
