Louisville Municipal Code Sec. 16.16.060 requires a public land dedication, or <br />equivalent value through cash -in -lieu, at the time of final subdivision plat to meet <br />a public purpose, such as parks, open space, schools, or any other public <br />purpose determined by the City. The minimum requirement for such public land <br />dedication for commercial development is 12% of the gross project area. <br />Based on a previous annexation agreement, an approximately 80-acre portion of <br />the property is exempt from the public land dedication requirement. The <br />minimum public land dedication requirement for the remaining 309 acres is 37.1 <br />acres of public use lands. The proposed public land dedication of 89.9 acres <br />exceeds the minimum requirement by 52.8 acres. <br />A final subdivision also includes construction design documents for public <br />infrastructure, including trails, underpasses and right of way landscaping. Under <br />the current proposal, the landscaping in the rights of way would be in the <br />jurisdiction of the City but maintained by the Metro District through an agreement <br />with the City. No improvement are planned in the park or open space tracts <br />other than trails. Attached are the construction documents for these elements of <br />the proposal. <br />Part of the development review process for a subdivision plat includes a <br />recommendation from the Parks and Public Landscaping Advisory Board <br />(PPLAB) to the Planning Commission and City Council on relevant parts of the <br />application. A petition was filed <br />for a referendum concerning the approval of the Redtail Ridge GDP, which sent <br />the ordinance approving the application to Louisville residents for a vote.
