City Council <br />Meeting Minutes <br />June 21, 2022 <br />Page 4 of 9 <br />Mayor Stolzmann closed the public hearing. <br />VOTE: Motion carried by unanimous roll call vote. <br />ORDINANCE NO. 1837, SERIES 2022 — AN ORDINANCE AMENDING TITLES 15, <br />16, AND 17 OF THE LOUISVILLE MUNICIPAL CODE CONCERNING MAILED <br />NOTICES OF PUBLIC HEARINGS AND CERTAIN LAND USE APPLICATIONS <br />UNDER REVIEW — 2"d READING, PUBLIC HEARING (advertised Daily Camera <br />5/22122) <br />Mayor Stolzmann introduced the item by title and opened the public hearing. <br />Planner Elizabeth Kay Marchetti stated the proposed ordinance would require <br />applicants, rather than staff, to accomplish the mailing of public hearing notices for <br />certain land use applications. She reviewed the costs and time involved for staff to <br />prepare these notices and noted the proposed process is how most other cities handle <br />such notices. She also reviewed the types of land use cases for which this new process <br />would be used. <br />She stated this proposed change does not affect the publishing or posting aspects of <br />notice nor the radius for which notices are required. If Council is interested in changing <br />the radius for notification, another ordinance would be required. <br />Councilmember Most asked how staff will be sure the applicant follows through on the <br />noticing. Planner Kay Marchetti stated the applicant will be required to certify it has <br />been done but submitting the appropriate forms. <br />Mayor Stolzmann asked about changing the notification radius to 750 feet. Acting <br />Manager Davis responded that is not included here but can be done by ordinance. <br />Planning Director Zuccaro added that staff was to improve the existing process. If <br />changes are made to the distance requirement staff would want input from Council on <br />different distance requirements that might apply to different types of applications. <br />Councilmember Dickinson was concerned this process will be too onerous for the <br />smaller applicants to handle and would prefer they have an option to pay for the service. <br />Planner Kay Marchetti responded that the impact of city staff doing this work is <br />significant at 8-24 hours per week. This process is used in other communities in the <br />region and across the country. Staff would continue to generate the notice content, <br />provide the mailing list and guidance. <br />Mayor Stolzmann stated the code requires the applicant provide stamped, addressed <br />envelopes for all properties within the notification area. Director Zuccaro responded that <br />sometimes the envelopes are provided and sometimes they are not. Sometimes the <br />staff just makes the decision to do the entire process of notification. <br />
