Planning Commission <br />Meeting Minutes <br />August 11, 2022 <br />Page 3 of 10 <br />Ritchie says the owner is Stephen Tebo and the applicant is the operator of the <br />restaurant. With every land use application the owner has to give consent, which he has <br />done. <br />Krantz asks if the LED string lights comply with the City's lighting requirements. <br />Ritchie says string lights are typically very low voltage bulbs and our current code is <br />pretty silent on this. Staff will get a more complete analysis with the PUD Amendment. <br />Howe asks if staff can comment on the hours of operation and if there will be live music. <br />Ritchie says there is no limitations on hours of operation but if the commission feels the <br />need to add a condition stating what those hours should be, they can do so at time of <br />approval. We do not have a condition on whether or not they can have live music. <br />These are good questions for the applicant though. <br />Applicant Presentation: <br />Applicants: Paul Rossi, Paul Lichty <br />None is heard. <br />Commissioner Questions of Applicant: <br />Howe asks what the hours of operation will be and if they will have live music. <br />Rossi says they will be open Monday — Wednesday: 3-9pm, Thursday/Sunday: 11- <br />9pm, and Friday — Saturday: 11-10pm. We do plan to have live music. <br />Moline asks if they can speak on how they see this use through the year. <br />Rossi says he can see it being used through January or February, depending upon the <br />weather. <br />Brauneis asks if the applicant is working on obtaining a liquor license. <br />Ritchie says they are working on getting this with the City Clerk's office. <br />Rossi shows the commissioners where the gates will be on the property and the main <br />entrance for the garden. <br />Howe says he is concerned about safety when people are walking back and forth. <br />Rossi says there is parking lot lighting when it is dark. We will be installing solar lighting <br />though. <br />Diehl asks if there will be normal amplified music when there is no live band. <br />Rossi says there will not be music outside of a live band. <br />Public Comment: <br />Mark Cathcart, 1763 Sweet Clover Lane <br />Cathcart says it is an interesting use for a parking lot. He recommends having shade. <br />Closing Statement by Applicant: <br />Rossi says the PUD Amendment will have shade sails on a 4x4 post and we will ensure <br />that those are safe. We will have large umbrellas on each table as well. <br />Discussion by Commissioners: <br />Diehl says he is supportive of this going to nine months instead of 90 days. It is a good <br />use of the parking lot and he looks forward to enjoying it someday. He mentions the <br />idea of creating a condition that live music is not permissible after 9pm. <br />Krantz is in support of this and would like to hear from the commissioners on possible <br />conditions relating to the live music and crosswalk safety precautions. <br />Moline is in support. He is in favor of making this parking lot more usable. <br />
