City0f ECONOMIC VITALITY COMMITTEE <br />Louisville <br />COLORADO -SINCE 1878 <br />SUBJECT: DISCUSSION - ORDINANCE 1851, SERIES 2023 — AN <br />ORDINANCE AMENDING TITLE 17 OF THE LOUISVILLE <br />MUNICIPAL CODE CAPPING THE MAXIMUM NUMBER OF <br />GASOLINE AND AUTOMOBILE SERVICE STATIONS <br />DATE: MARCH 10, 2023 <br />PRESENTED BY: ROB ZUCCARO, AICP, COMMUNITY DEVELOPMENT <br />DIRECTOR <br />SUMMARY: <br />Proposed Ordinance 1851, Series 2023 (see Attachment No. 1) would create the <br />following limitations and requirements for new and existing gasoline and automobile <br />service stations: <br />- Limit the number of existing or approved gasoline and automobile service <br />stations to six (current number of existing and approved stations), with an <br />exception to allow an increase to a limit of seven stations if the seventh station is <br />part of a new, large single -user retail center. <br />- Require 1,000-foot spacing of new gasoline and automobile service stations from <br />existing stations, with an exception if the new station is part of a new, large <br />single -user retail center. <br />- Automatically expire Planned Unit Developments (PUD) and Special Review Use <br />(SRU) approvals for gasoline and automobile service stations that do not pull <br />building permits within three years following approval. <br />- Automatically expire any PUD and SRU approval of an existing gasoline or <br />automobile service station that discontinues use for one year. <br />- Require installation of electric vehicle (EV) fast charging stations for any <br />expanded, modified or new gasoline or automobile service station equaling 20% <br />of the number of gasoline pumps at the stations, with no fewer than two such <br />charging stations. <br />As part of passage of the first reading of the ordinance on February 21, 2023, City <br />Council approved an extension to the second reading and public hearing from March 7, <br />2023 to March 21, 2023 to allow for more community dialogue regarding the proposed <br />ordinance. The EVC will be discussing the proposed ordinance during its March 10 <br />meeting. The March 10 meeting materials are included as Attachment #1. <br />BACKGROUND: <br />On November 1, 2022, the City Council adopted Ordinance 1843, Series 2022 as an <br />emergency ordinance, setting a moratorium on the submittal of land use applications for <br />new gasoline or automobile service stations (see Attachment No. 2). City Council <br />initiated the moratorium following the submittal of a citizen -initiated petition that would <br />ban new gasoline and automobile service stations in all zone districts and not allow <br />building permits for new facilities within 2.5 miles of any existing facility (see Attachment <br />CITY COUNCIL COMMUNICATION <br />
