Sec. 3.18.050 <br /> <br /> A. <br /> <br /> 1. <br /> <br />o <br /> <br />(d) <br /> <br /> Impact Fees should be modified, and if so, what the amount <br /> should be, based on the standards in Section 3.18.040.C.2(d), <br /> Standards. <br /> <br />Standards. <br />If, on the basis of generally recognized principles of impact analysis it is <br />determined the data, demand information and assumptions used by the <br />applicant to calculate the Impact Fees in the Independent Fee Calculation <br />Study more accurately measures the proposed Impact-Generating <br />Development's impact on the appropriate Capital Facilities, the Fees <br />determined in the Independent Fee Calculation study shall be deemed the <br />Fees due and owing for the proposed development. The Fee adjustment <br />shall be set forth in a Fee Agreement. If the Independent Fee Calculation <br />Study fails to satisfy these requirements, the Fees applied shall be the Fees <br />established in Appendix A: Impact Fee Schedule. <br /> <br />Credits. <br /> <br />Standards. <br /> <br />General. <br />Any person causing the Commencement of Impact-Generating Development may <br />apply for credit against Impact Fees otherwise due, up to but not exceeding the full <br />obligation of Impact Fees proposed to be paid pursuant to the provisions of this <br />Chapter, for any contributions, construction, or dedication of land (where <br />appropriate) accepted by the City for City Municipal Capital Facilities, Police Capital <br />Facilities or Transportation Capital Facilities. Credits against Municipal Fees shall be <br />provided only for Municipal Capital Facilities. Credits against Police Fees shall be <br />provided only for Police Capital Facilities. Credits against Transportation Fees shall <br />be provided only for Transportation Capital Facilities on the City's Road System. <br /> <br />Valuation of Credits. <br /> <br />(a) Land Dedication. <br /> <br />Credit for land dedication, at the Fee Payer's option, shall be valued at <br />either (1) 100 percent of the most recent assessed value for such land as <br />shown in the records of the County Assessor, or (2) the fair market value <br />of the land established by a private appraiser acceptable to the City in an <br />appraisal paid for by the Fee Payer. <br /> <br />(b) Construction. <br /> <br />10 <br /> <br /> <br />
