City Manager or Manager's designee, and shall not require additional action <br /> by the City Council to be effective. <br /> <br />(b) Impact-Generating Development Not Listed in Appendix A: Impact <br />Fee Schedule. <br /> If the proposed Impact-Generating Development is of a type not listed in <br /> Appendix A: Impact Fee Schedule, then the Impact Fees applicable to the <br /> most nearly comparable type of land use listed in Appendix A shall be used. <br /> The determination of the most nearly comparable type of land use shall be <br /> made by the City Planning Director or designee with reference to the Impact <br /> Fee Study and City zoning code. <br /> <br />(c) Mix of Uses. <br /> If the proposed Impact-Generating Development includes a mix of those <br /> uses listed in Appendix A: Impact Fee Schedule, then the Impact Fees shall <br /> be determined by adding up the Impact Fees that would be payable for <br /> each use as if it was a freestanding use pursuant to Appendix A. <br /> <br />Independent Fee Calculation Study. <br />In lieu of calculating the amount(s) of Impact Fees by reference to Appendix A: <br />Impact Fee Schedule, a Fee Payer may request that the amount of the required <br />Impact Fee be determined by reference to an Independent Fee Calculation Study. <br /> <br />(a) Preparation of Independent Fee Calculation Study. <br /> If a Fee Payer requests the use of an Independent Fee Calculation Study, <br /> the Fee Payer shall be responsible for retaining a qualified professional (as <br /> determined by the City Manager or designee) to prepare the Independent <br /> Fee Calculation Study that complies with the requirements of this Chapter, <br /> at the Fee Payer's expense. <br /> <br />(b) General Parameters for Independent Fee Calculation Study. <br /> Each Independent Fee Calculation Study shall be based on the same LOS <br /> standards and unit costs for City Municipal Capital Facilities, Police Capital <br /> Facilities and Transportation Capital Facilities used in the Impact Fee Study, <br /> and shall document the relevant methodologies and assumptions used. <br /> <br />(c) Procedure. <br /> <br /> (1) An Independent Fee Calculation StUdy shall be undertaken <br /> through the submission of an application to the City Planning <br /> Director or designee, along with an application fee to defray the <br /> costs associated with the review of the Independent Fee <br /> Calculation Study. <br /> <br /> (2) Within fifteen (15) days of receipt of an application for <br /> Independent Fee Calculation Study, the City Planning Director or <br /> designee shall determine if the application is complete. If it is <br /> determined the application is not complete, a written statement <br /> specifying the deficiencies shall be sent by mail to the person <br /> submitting the application. The City Planning Director or designee <br /> shall take no further action on the application until it is complete. <br /> <br /> (3) When it is determined the application is complete, the application <br /> shall be reviewed by the City Planning Director or designee and a <br /> written decision rendered within thirty (30) days on whether the <br /> <br /> <br />
