The Impact Fees for Municipal Capital Facilities, Police Capital Facilities, and <br />Transportation Capital Facilities established by this Chapter. The Impact Fee Schedule is set <br />forth in Appendix A to this Chapter and is incorporated herein by reference. <br /> <br />N. Impact Fee Study. <br /> <br />The study entitled Impact Fees: Ci(y of Louisville, Colorado, prepared by Tischler & Associates <br />dated September 3, 2003. <br /> <br />O. Independent Fee Calculation Study. <br /> <br />A study prepared by a Fee Payer, calculating the cost of Municipal Capital Facilities, Police <br />Capital Facilities, or Transportation Capital Facilities required to serve the Fee Payer's <br />proposed development, that is performed on an average cost (not marginal cost) <br />methodology, uses the level of service standards, service units and unit construction costs <br />stated in The Impact Fee Study, and is performed in compliance with any criteria for such <br />studies established by this Chapter. <br /> <br />P. Level of Service (LOS). <br /> <br />A measure of the relationship between service capacity and service demand for Capital <br />Facilities (in this Chapter Municipal Capital Facilities, Police Capital Facilities, and/or <br />Transportation Capital Facilities). <br /> <br />Q. Low-Income Housing. <br /> <br />A residential dwelling unit which is required, by binding legal instrument acceptable to the <br />City and duly recorded with the County Clerk and Recorder, to be occupied by and <br />affordable to Iow-income households for at least twenty (20) years, and which is either a <br />dwelling unit which is available for rent on terms that would be affordable to households <br />earning eighty (80) percent or less of the median income of City residents, as adjusted for <br />family size, and paying less than thirty (30) percent of their gross income for housing, <br />including rent and utilities, or a dwelling unit which is available for purchase on terms that <br />would be affordable to households earning eighty (80) percent or less of the median income <br />of City residents, as adjusted for family size, and paying less than thirty-eight (38) percent of <br />their gross income for housing, including principal, interest, taxes, insurance, utilities and <br />homeowners' association fees. <br /> <br />R. Municipal Capital Facilities. <br /> <br /> The building improvements for office space to the Louisville City Hall and the building <br /> improvements to the City's Public Works Yard, as defined in the Impact Fee Study. Municipal <br /> Capital Facilities do not include the costs of vehicles and equipment. <br /> <br />S. Non-Site Related Improvements. <br /> <br /> Transportation Capital Facilities that are on the City's Road System that are not Site-Related <br /> Improvements. <br /> <br />T. Person. <br /> <br /> Person means an individual, corporation, limited liability company, governmental agency, <br /> business trust, estate, t_mst, partnership, association, two (2) or more persons having a joint <br /> or common interest, or any other entity. <br /> <br />U. Police Capital Facilities. <br /> <br /> The building improvements for the City's new police headquarters and new communications <br /> equipment, defined in the Impact Fee Study. Police Capital Facilities do not include the costs <br /> <br /> <br />
