February 15, 1977 Minutes - page 9 SCHOOL ANNEXATION CONTINUED Mr. Wurl stated that the school district re- quested an updated letter requesting the annex- ation of the proerpty from the City as they are now considereing it. Councilman Domenico moved that the City Ad~ ministrator be authorized to send a letter to the school district requesting the annex- ation of the strip of land near the elementary school. Seconded by Councilman McDonald. Motion carried. ANNEXATION FEES Mr. Wurl stated that a question was brought up at the recent annexation considerations about the annexation fees. He stated that there was a provision in the annexation re- gulations which deferred the fees until de- velopment was proposed. Mr. Wurl stated the reasons concerning the deferred payment and suggested that Council consider leaving the policy as is, or leave the policy as is, but also charge a lump sum to cover the costs of City review of annexation proposals. After consideration, Councilman Caranci moved that a resolution be drafted leaving the pre- sent policy as is but also charge a lump sum to cover the costs of City review of annexation proposals. Seconded by Councilman DiCarlo. Motion carried. PUBLIC SERVICE FRANCHISE Mr. Wurl stated that he met with Public Service and was able to resolve almost all of the differences under the franchise proposal. Public Service sent a letter of agreement which covers much of councils concerns. The representative did present to the City a copy of the letter stating that Public Service will insure the Mayor and Council that they intend to pay the 2% gross receipts for gas and electric services called for in the pre- vious franchise and on formal acceptance by both parties of the new franchise, the com- pany will pay to the City any difference be- tween what is agreed upon in the new franchise as compared to the old one, retroactively until the old franchise expires and the new one takes place. There were no comments. Councilman DiCarlo moved that the City Admin- istrators report be accepted and placed on file. Seconded by Councilman McDonald. Motion carried.
