February 15, 1977 Minutes - page 8 HUD MEETING CONTINUED City Attorney Joss stated that there were not any regulations about advertising; how- ever, the HUD attorney stated that she would recommend advertising with City Attorney Joss concurring. Councilman McDonald asked if for some reason, the City designated 80%, and the HUD audit showed only 60% work complete, would the City have to reimburse the CD funds. Attorney Joss stated that M_r. Metzler stated that at this time the policy reads that the City would have to reimburse the CD funds. There were no other comments on the matter. Councilman McDonald moved that the City Attorney's report be accepted and placed on file. Seconded by Councilman DiCarlo. All in favor. Motion carried. CITY ADMINISTRATOR REPORT HOWARD DITCH Mr. Wurl reported that Engineer White was elected President of the Howard Ditch Company. TREES Mr. Wurl stated that there has been a long standing dispute with First Federal Savings as relates to tree installation in the re- gulations. The City felt that the development should be required to put in the trees; however, they platted during the time that the subdivision regulations were being adopted. Mr. Wurl stated that he has discussed the matter with the City Attorney and since that discussion Engineer White informed Mr. Wurl that there was a replat that effect 18 of the lots in question. He stated that he would like to further review it with the City Attorney and get back with First Federal. WATER RESTRICTIONS Mr. Wurl stated that he has been reviewing the matter and at this time staff felt that the citizens of the community should be asked to curb their water usuage. Later on fliers could be distributed to the homeowners in the City. SCHOOL ANNEXATION Mr. Wurl stated that several times in the past, the school district was requested to annex the property at the Elementary School.
