<br />WARDN REQUEST CONT'D <br /> <br />WESTERN EMPIRE CONSTRUCTORS <br />PAY ESTIMATE #4-WATER TANK <br /> <br />TRAINOR CONSTRUCTION CO. <br />PAY ESTIMATE #2 <br />STORM SEWER <br /> <br />Councilman DelPizzo inquired how many <br />water shares were included with the 80 acres. <br />Mr. Cox replied 58.33 Goodhue Ditch. <br />Councilman Domenico moved that the Warren <br />Ward request be accepted by Council and <br />be referred to the Planning Commission <br />for review. Seconded by Councilman <br />DelPizzo. <br />Councilman Caranci inquired if there were <br />any fees connected with the annexation re- <br />quests. <br />Mr. Wurl stated that since there is no <br />development taking place on the property <br />at this time, the ordinance carried a <br />provision that the fees could be delayed <br />until platting and development. <br />Councilman Caranci asked if the property <br />is not developed within a certain length <br />of time and city utilities are available <br />in the area, would the city be obligated <br />to provide these services. <br />Mr. Wurl explained there was a clause <br />in the annexation agreement that the City <br />is not liable to serve utilities until <br />the plat has been approved by the <br />Planning Commission and accepted by the <br />Council. <br />Roll call vote was taken on the motion. <br />Domenico yes, McDonald yes, Caranci yes, <br />DelPizzo yes, DiLorenzo yes, DiCarlo yes. <br />Motion carried. <br /> <br />Councilman Caranci moved that Pay Estimate <br />#4 to Western Empire Constructors in the <br />amount of $97,729.99, less 10% retainage <br />of $19,773.00 - net amount of $87,956.99 <br />be apid. Seconded by Councilman DelPizzo. <br />Under remarks Councilman DiCarlo stated <br />he understood from the affidavit members <br />of council could not reject their work on <br />the first three pay estimates if something <br />went wrong creating problems. <br />Engineer White assured Council this was <br />not the case, there is a one year guaran- <br />tee on the project after final acceptance <br />by Council. <br />The motion was then carried for payment <br />of pay estimate #4. <br /> <br />Counciolman McDonald moved that Trainor <br />Construction Co. Pay Estimate #2 in the <br />amount of $5,592.60 for stom sewer be paid. <br /> <br />-3- <br />
