<br />STATUE DEDICATION <br /> <br />Steve Anderson informed Council that the <br />Miners Statue has been installed and <br />the dedication date has been set for <br />January 8, 1977. <br /> <br />CITY ATTORNEY REPORT <br />MAYHOFFER SUIT <br /> <br />Mr. Wurl reported that the Mayhoffer <br />suit is still scheduled for December <br />28, 1976. <br /> <br />PIERCE SUIT <br /> <br />Mr. Wurl reported that Attorney Schroeder <br />has all the information and has got an <br />extension until December 27, 1976. <br /> <br />ORDINANCE #507 <br />ZONING ORD. AMENDMENT <br /> <br />Mr. Wurl stated that the amendment per- <br />tains to day care homes and geologic <br />hazard areas. <br />Mr. Wurl read Ordinance #507 by title <br />only on second reading. <br />Mayor Waschak opened the public hearing. <br />Mrs. Gail Petz, 932 Main Street. She <br />stated that she had recently bought the <br />property for a possible child care center <br />and she stated that she was: infonmed that <br />the amendment would allow centers in <br />commercial areas. <br />Mr. Drumm stated that the amendment does <br />not allow for the centers in commercial <br />areas. <br />She stated that in talking with Mel <br />Stephan, he understood the situation <br />that currently they are not allowed, but <br />with the passage of the amendment they <br />would be. <br />She stated that the facilities do have <br />to be checked by the state health dept. <br /> <br />Mr. Drumm stated that the reasoning be- <br />hind the designation was that where you <br />have children should not be near the <br />heavy traffic areas, therefore making <br />residential areas better. <br />Mrs. Petz stated that it would be a parent <br />drop off and pick up, there would not <br />be any children walking to the center. <br />Mr. Wurl stated that he did advise the <br />realtor on the property that the pro- <br />perty should not be closed on until the <br />matter had been finalized by Council. <br />Mayor Waschak closed the public hearing <br />and referred the matter to Council for <br />discussion. <br /> <br />-3- <br />
