<br />ORDINANCE #502 CONT'D <br /> <br />Mayor Waschak closed the public hearing. <br />Councilman DelPizzo moved that Ordinance <br />#502 be adopted as amended. Seconded <br />by Councilman McDonald. Roll call. <br />DiLorenzo yes, DelPizzo yes, DiCarlo yes, <br />McDonald yes. Motion carried. <br />Mr. Drumm stated that the LUC has been <br />notified about the changes. He also <br />stated that the City had promised by <br />Resolution and verbally to notify the <br />LUC of any changes that occured between <br />first and second readings of the Ordinances. <br />The City will send a copy of the changes <br />to the LUC so they will be aware of them. <br />Mr. Mizel stated that he thought the <br />first phase of zoning and annexation has <br />technically been completed and wished <br />to thank the City staff for all their <br />efforts and indulgence. <br /> <br />COAL CREEK STATION <br />FILING #2, PRELIMINARY <br />PLAT DEVELOPMENT PLAN <br />PUBLIC HEARING <br /> <br />Mr. Wurl stated that the owners are <br />present to answer any questions and <br />the staff would give an update of the <br />prQject. <br />Mr. White stated that Mr. Brock of A & B <br />Company has submitted plat for Coal <br />Creek Station Filing #2, which is the <br />existing railroad cars and water tower. <br />This will provide Mr. Brock to sell the <br />cars individually. Each person would <br />then participate in a home owners asso- <br />ciation and would contribute to the main- <br />tenance of the existing 145 parking <br />facilities which we feel will be suf- <br />ficient parking for the area. <br />The plan presented meets the rules and <br />regulations and Ordinances of the City <br />and should be approved as is. <br />Mr. White reiterated that each time any <br />lot is sold, Council will see a final <br />development plan showing what will or <br />has occured in very significant detail. <br />It was stated by Mr. Brock that there <br />would be no removing of the cars, as they <br />are physically attached and it would <br />require going to someone elses property <br />to remove yours. <br />PUD's and things of this nature give <br />you control that this could never occur <br />unless there was a situation where a <br />fire, flood or act of God damaged the <br />structure, it could be replaced. <br />Mr. White stated that there would be an <br />additional 20 foot dedication of land <br />making a total of 50 fee land dedication <br /> <br />south of the South Boulder Rd. center line. <br /> <br />5. <br />
