<br />CITY ATTORNEY REPORT <br />ORDINANCE #491 <br />POLICE OFFICERS APPOINT- <br />MENT BY CITY ADMINISTRATOR <br /> <br />Mr. Wurl stated that an amended page one <br />has been distributed to Council. Mr. <br />Wurl stated that the page was amended in <br />a way that he felt the Council had sug- <br />gested. Mr. Wurl read Ordinance #491 <br />on second reading by title only. <br />Councilman Caranci stated that as amended <br />the City Administrator could fire anyone <br />he wishes without the consent of Council. <br />Mr. Wurl stasted that if a City Adminis- <br />trator attempted to do something like <br />this it would be probable that the City <br />Council would then in turn dismiss the <br />City Administrator; therefore, the <br />control is still in the hands of the <br />Council with the City Administrator doing <br />the work under Council. <br />Chief Munger stated that in a case where <br />the City Administrator would fire him; <br />he would have recourse to appraoch City <br />Council for an appeal. Mr. Wurl stated <br />that Ordinance #491 will get the police <br />department out of the statutory re- <br />gulations and into the City Personel Code. <br />Councilman DiCarlo stated that in the <br />Personel Code there are several steps which <br />are followed for an appeal; however there <br />is not one which states that you can go <br />directly to Council. <br />Mr. Wurl stated that it would be wrong for <br />a party to come directly to Council without <br />having some sort of documentation <br />prepared at the presenting of his appeal. <br />Councilman DiCarlo stated that he felt <br />the person appealing should be entitled <br />to appeal directly to Council and that <br />Council should be able to do their own <br />investigation. <br />Discussion was held in regards to the <br />enforcing of certain ordinance by the <br />Police Department. Council felt that the <br />police should be made aware of violations <br />of City Ordinances and proceed to issue <br />summons where necessary. <br />Chief Munger stated that after codification <br />of the Ordinances it will be easier to <br />determine what ordinances are being violated. <br />Council stated that in section 8.2 in <br />Ordinance #491; under the reporting of a <br />violation by a police officer the report <br />should be made to the City Administrator <br />not the City Council. <br /> <br />-3- <br />
