<br />WATER & SANITATION <br />FACILITIES AGREEMENT CONT'D <br /> <br />ANNEXATION ORDINANCES <br /> <br />Mr. Mizel stated that he has the option <br />to buy the 4.6 shares of water when Gary <br />Varra has quit farming nad part of the <br />mortgage is paid off. He stated that he <br />would assign the option to buy those <br />shares of water to the City if they <br />wished. Mr. Mizel stated that he has <br />bought all water shares which were avail- <br />able to him. <br />After discussion Councilman DiCarlo <br />moved that the Mayor be authorized to <br />enter into the Water & Sanitation <br />Facilities Agreement with the developer <br />with the amendment; that any other water <br />acquired by the developer historically <br />utilized with this annexation shall be <br />assigned to the City at no cost to <br />the City plus the modifications stated <br />by Attorney Morris as follows: Developer <br />specifically agrees to acquire the 4.6 <br />shares of Farmers Reservoir & Irrigation <br />Corporation owned by Gary Varra and <br />transfer the same to the City of Louisville <br />Colorado, when developer is entitled to <br />purchase the same, all at no cost to the <br />City and developer further agrees to <br />transfer to the City any other water <br />rights that developer may acquire which <br />were historically used on the property <br />being annexed. Seconded by Councilman <br />McDonald. Roll call: McDonald yes, <br />Caranci yes, DelPizzo yes, DiLorenzo yes, <br />DiCarlo yes, Domenico yes. Motion carried. <br /> <br />Attorney Morris stated that the properties <br />in Ordinances #467, 468, 469 and #470 were <br />by petition signed and duely submitted to <br />to the City. They have been signed by <br />100% of the land owners of the area to <br />be annexed and that said petition, maps <br />and documents attached thereto meet the <br />requirements for the same as provided by <br />law. More then 1/6 the perimeter of the <br />area proposed to be annexed is contiguous <br />to the city limits of Louisville and a <br />community of interest exists between the <br />terriorty proposed to be annexed and the <br />City of Louisville; and that the territory <br />proposed to be annexed will be urbanized <br />in the near future and the territory pro- <br />posed to be annexed is capable of being <br />integrated into the City of Louisville. <br /> <br />-4- <br />
