REVISED 12/96 MOBLEY ANNEXATION AGREEMENT Sisk moved that Council approve the annexation agreement as shown in the 12/96 revision, seconded by Howard. Roll call was taken. Motion passed by a 6 - 0 vote with Lathrop being absent. ORDINANCE NO. 1247, SERIES 1997 - APPROVING A LEASE AGREEMENT BETWEEN THE CITY OF LOUISVILLE AND DUANE DAUGHENBAUGH AND RUSSELL DAUGHENBAUGH - 2ND READING - PUBLIC HEARING (PUBL. LSVL. TIMES 1/11/97) Griffiths read by title only Ordinance No. 1247, Series 1997, "An ordinance approving a lease agreement between the City of Louisville and Duane Daughenbaugh and Russell Daughenbaugh." Bill Simmons, City Administrator, stated that the City's closing on the Daughenbaugh property took place on Friday, January 3, and part of the condition of sale was to allow the seller to lease back the property until April 1, 1998. The seller can only use the property for those uses as outlined in the letter dated December 5, 1996: The lease had a monthly rate of $100 and allowed the seller to remove personal property, fixtures, structures, or improvements on the property, except for wire fence on the boundaries of the property. Russell Daughenbaugh will be occupying the single family residence. Davidson opened the public hearing calling for anyone wishing to speak on Ordinance No. 1247. NONE Davidson closed the public hearing and called for Council comments. Mayer asked about the issue of liability. Simmons stated that the lease required the Daughenbaughs to provide liability insurance and coverage as specified in the lease. Without that, there will be no lease. Howard moved that Council approve Ordinance No. 1247, Series 1997, approving a lease agreement between the City of Louisville and Duane and Russell Daughenbaugh on second reading, seconded by Sisk. Roll call was taken. Motion passed by a 6 - 0 vote with Lathrop being absent.
