Sisk wanted notification given to residents affected by the project as it moves into their <br />neighborhood. <br />Sisk moved that Council authorize the Mayor to execute the contract on behalf of the City in the <br />amount of $1,115,788.25 with Western Mobile/Boulder and authorize staff to execute change orders <br />up to $25,000 for the street projects identified as Nos. 1 8 inclusive on the Council Communication, <br />seconded by Keany. Roll call was taken. Motion passed by a 6 0 vote with Howard being absent. <br />ORDINANCE NO. 1242, SERIES 1996 AMENDING THE PLANNED UNIT <br />DEVELOPMENT REGULATIONS CONTAINED IN CHAPTER 17.28 OF THE <br />LOUISVILLE MUNICIPAL CODE TO INCORPORATE INTO SUCH REGULATIONS <br />SPECIFIC REFERENCES AND REQUIREMENTS CONCERNING COMMERCIAL AND <br />INDUSTRIAL DEVELOPMENT DESIGN GUIDELINES; TO SPECIFICALLY ADDRESS <br />1HE Et1FECT OF APPROVAL OF A PRELIMINARY PLANNED UNIT DEVELOPMENT <br />PLAN, AND TO MAKE O 1]IER AMENDMENTS TO CHAPTERS 15.04, 17.16 AND 17.28 <br />OF THE LOUISVILLE MUNICIPAL CODE IN CONNECTION THEREWITH 2ND <br />READING PUBLIC HEARING CONTINUED FROM 6/03/97 MEETING <br />Griffiths read by title only Ordinance No. 1242, Series 1997, "An ordinance amending the Planned <br />Unit Development regulations contained in Chapter 17.28 of the Louisville Municipal Code to <br />incorporate into such regulations the Louisville Commercial Development Design Standards and <br />Guidelines; to incorporate into such regulations specific references and requirements concerning <br />commercial and industrial development design Standards and Guidelines; to specifically address the <br />effect of approval of a preliminary planned unit development plan, and to make other amendments <br />to Chapter 17.28 of the Louisville Municipal Code in connection therewith." <br />Davidson opened the public hearing. <br />Paul Wood, Planning Director, pointed out that the relationship between the ordinance and the <br />CDDSG remained unchanged from first reading. Section 4 of the ordinance adopts the CDDSG as <br />an appendix to Chapter 17.28 of the Municipal Code which contain the City's PUD regulations. The <br />ordinance also retained to Council the flexibility to waive or modify any requirements of the CDDSG <br />within the PUD process. The ordinance requires that the Standards and Guidelines apply to both <br />commercial office and commercial retail. The ordinance clarified that a preliminary approval of a <br />preliminary PUD plan did not create a vested property right to develop under, rather approval of a <br />preliminary PUD entitled the developer to proceed with a final PUD submittal. Site coverage would <br />be 70% for building coverage, parking, and drives, 30% for open space coverage which may include <br />oriented areas, such as sidewalks and hard scaped plazas within the open space areas and pedestrian <br />gathering places. He pointed out that in Council's packet was a June 12, 1997, letter from Koebel <br />Co. asserting their position that the Commercial Development Design Guidelines would not apply <br />to either Centennial Valley Business Park or the Centennial Valley Market Place. <br />Davidson called for anyone wishing to speak on Ordinance No. 1242. <br />
