Howard was not in favor of increasing the size of the flag poles. He could live without condition No. <br />3, minimum 3' setback: He agreed with Keany's suggestion for crosswalk improvements. He felt <br />conditions No. 2, 6, 7, and 8 should remain unchanged and No. 4 be changed to increased shrubbery. <br />Davidson was in favor of allowing the up- lighting of the flagpoles. <br />Tami Tanoue, City Attorney, pointed out that on the fourth "WHEREAS" a few words were missing. <br />She asked that at the end of the second line the words, "should be approved, with the following <br />conditions:" be added. <br />Davidson moved that Council approve Resolution No. 33, Series 1997, with the words the City <br />Attorney just added, deleting condition No. 1, changing condition No. 2 to .delete the words from <br />and that there is no. up- lighting of the flags; deleting conditions No. 3, 4, and 5, leaving <br />conditions No. 6, 7, and 8 in, adding the condition that the sign be approved by staff, and adding the <br />condition that the access from Rite -Aid to Eagle be a full four -way stripe, seconded by Levihn. Roll <br />call was taken. Motion passed by a 5 0 vote with Sisk and Lathrop being excused. <br />RESOLUTION NO. 34, SERIES 1997 APPROVAL OF INTERGOVERNMENTAL" <br />AGREEMENT LOUISVILLE /SUPERIOR <br />Bill Simmons, City Administrator, stated that for several weeks the Mayor, Mayor Pro -tem, along <br />with other elected officials from Superior had been negotiating an Intergovernmental Agreement to <br />try to resolve language issues between Louisville and Superior. He reviewed the highlights of the <br />agreement (SEE ATTACHED). The Superior Board of Trustees had reviewed this and their only <br />comment related to paragraph No. 13 relating to transportation issues. He had the suggested changes <br />available for Council's review. <br />Davidson called for Council comments. <br />Mayer felt the transportation issues were not clear as far as commitment. He asked what Louisville's <br />commitment was. <br />Davidson stated that the total commitment is the sales tax generated off Biella/Menkick. <br />Simmons wanted to look at the agreement to make sure there is no obligation to appropriate beyond <br />what sales taxes are generated. <br />Davidson pointed out that Louisville had never said that the land exchange and sales tax sharing was <br />also an interchange agreement. Louisville agreed to one section of an interchange agreement where <br />Louisville would pledge its 2.7% it is going to collect towards their portion of the interchange. <br />Davidson stated that either Superior goes forward with this or Louisville will go back to Plan A. <br />11 <br />
