residential purposes upon the Lots, and shall not include fire <br /> flows unless provided by Seller at its sole expense: The sale <br /> of these taps shall be subject to the following terms and <br /> conditions, which shall be conditions precedent to the <br /> provision of water service: <br /> (1) Seller shall pay all tap fees associated with each <br /> tap at in-City rates, in the amount required by <br /> Louisville City ordinances in effect at the time of <br /> application for each tap. Seller shall also pay all <br /> costs of extending water service to the Lots and of any <br /> water treatment beyond Louisville' s normal treatment . <br /> (2) Seller shall execute and deliver to Louisville a <br /> petition for inclusion of the Lots into the Northern <br /> • Colorado Water Conservancy District and Municipal <br /> Subdistrict . <br /> (3) Seller and Louisville s - 1 - . - - - e <br /> agm <br /> reeent which shall address water quality and <br /> treatment; acknowledgment of lack of fire flows, unless <br /> provided by Seller at its sole expense) ;, line sizing <br /> (which shall be the minimum necessary for residential <br /> purposes) ; interruption and termination of water service; <br /> payment of tap fees (which shall be at in-City rates) ; <br /> water service rates and charges (which shall be in-City <br /> rates and charges) , and such other matters as set forth <br /> therein. <br /> (c) At the closing of the purchase of the Parcels, Seller <br /> shall record two properly executed and acknowledged deeds <br /> conveying the Lots to Seller. In consideration of the mutual <br /> promises and covenants contained herein, Seller shall also <br /> grant conservation easements to the Purchasers in the form as <br /> provided in Exhibit C attached hereto and by this reference <br /> incorporated herein over Lot A and Lot B, hereinafter referred <br /> to as the "Conservation Easements. " <br /> (d) Approval of the creation of the Lots will become <br /> effective only upon the following: <br /> (i) the recording in the Boulder County Clerk and <br /> Recorder' s Office of the deeds conveying the Lots <br /> from the Seller to Seller using the legal <br /> descriptions as set forth in Exhibit A-3; and, <br /> BOWES PURCHASE AGREEMENT, <br /> DIVISION OF LAND -4- <br />
