All facilities are required to meet applicable FCC regulations regarding human <br />health and exposure to radio frequency emissions. <br />Design standards specific to roof mounted facilities require that the antennae be; 1) <br />mounted on an existing penthouse structure, or 2) screened behind existing screening <br />on the roof, or 3) screened with new screening material that is compatible with existing <br />screening materials on the roof and overall project architecture. Building mounted <br />antennae shall not exceed the maximum building height for the zone district, or <br />applicable design standard. <br />SPECIAL REVIEW USE CRITERIA: <br />Louisville Municipal Code § 17.40.100.A lists five criteria to be considered by the <br />Planning Commission in reviewing a Special Review Use application, which follow. The <br />Planning Commission is authorized to place conditions on their recommendation of <br />approval, if they believe those are necessary to comply with all of the criteria. <br />1. That the proposed use /development is consistent in all respects with the spirit <br />and intent of the comprehensive plan and of this chapter, and that it would not be <br />contrary to the general welfare and economic prosperity of the city or the <br />immediate neighborhood; <br />It is the intent of the provisions of Chapter 17.42, which regulates CMRS facilities, to <br />provide a high level of communication services to the residents of the City. The <br />purpose of the code is to accommodate the growth of the telecommunications industry <br />in a reasonable manner that is consistent with the community aesthetic and design <br />goals. Staff finds this criterion is met. <br />2. That such use /development will lend economic stability, compatible with the <br />character of any surrounding established areas; <br />Staffs finds the building mounted CMRS facility meets both the general and the specific <br />design standards as required under Section 17.42.030. The placement of the roof <br />mounted antennae array is constrained by the extent of existing roof mounted HVAC <br />equipment. New screening elements have been incorporated into the design to <br />minimize visual impacts. The overall height of the antennae array does not exceed to <br />the maximum allowed building height in the AO zone district. All mechanical support <br />equipment is located in the basement of the existing building. Staff finds this criterion is <br />met. <br />3. That the use /development is adequate for the internal efficiency of the proposal, <br />considering the functions of residents, recreation, public access, safety and such <br />factors including storm drainage facilities, sewage and water facilities, grades, <br />dust control and such other factors directly related to public health and <br />convenience; <br />No ground mounted support mechanical equipment is proposed in this application. <br />There are no aspects of the use which will impact the internal efficiency, site layout or <br />function of the site. Staff finds this criterion is met. <br />4 <br />
