PAGE FOUR <br />SUBJECT: UPDATE/DISCUSSION – BOARD OF ADJUSTMENT (BOA) <br />DATE: MAY 25, 2010 <br />September 16, 2009 <br />533 County Rd. - Case #09-011-VA – Approval of two variances from Chapter 17 of the <br />Louisville Municipal Code (LMC). The variances are described as follows: <br />1. Variance from Section 17.12.050.F to allow a 14 feet 6 inch front yard setback <br />where 20 foot is required. <br />2. Variance from Section 17.12.050.G to allow for an attached garage that is not <br />setback 20 feet greater than the setback between the front property line and the <br />front building line of the dwelling. <br />Decision: Denied <br />September 16, 2009 <br />1008 Grant Ave. - Case #09-010-VA –Approval of a variance from Chapter 17 of the <br />Louisville Municipal Code (LMC). The variance is described as follows: <br />1. Variance from Section 17.12.050.C to allow for a predominant roof pitch less than <br />the 6:12 pitch required by the Old Town Overlay District Regulations. <br />Decision: Approved <br />November 18, 2009 <br />533 County Rd. – Rehearing of Case #09-011-VA –Approval of two variances from Chapter <br />17 of the Louisville Municipal Code (LMC). The variances are described as follows: <br />1. Variance from Section 17.12.050.F to allow a 14 feet 6 inch front yard setback <br />where 20 foot is required. <br />2. Variance from Section 17.12.050.G to allow for an attached garage that is not <br />setback 20 feet greater than the setback between the front property line and the <br />front building line of the dwelling. <br />Decision: Denied <br />2010 WORK GOALS <br />The Board of Adjustment will continue to hear Variance and Floodplain Development requests <br />th <br />as they are submitted. The first case before the BOA in 2010 will be heard on May 19. An <br />additional variance hearing is set for June 26, 2010. <br />Section 17.48.020 of the LMC titled “Members-Appointments” states “The board of adjustment <br />shall consist of six members who shall be appointed by the City Council”. At this point in time, <br />there are six regular members and one associate member of the BOA. Two of the regular <br />member positions will expire in December of 2010. Staff will consult with the Board members <br />whose terms are expiring to determine if they wish to re-apply. <br /> <br />
