411 • 11/5/81 Page -3- Councilman Meier Remarked it was hie opinion that #12 question on the application "Will the pro- posed change likely result in a change in consumption of beer or alcoholic beverages on or from the licensed premises?" may not be answered correctly with a no by the applicant. Attorney Rautenstraus stated it was his opinion the applicant felt he would not have more tables on the premises than is being utilized at the present time and therefore the "no" reply was permissible by applicant. Councilman Fauson Advised Council that he wished to abstain from voting on this particular application because he has Lite building next door and his alterations will affect his building. Further he had not contacted Councilman Fauson on his plans - this was his reason for abstaining. Also, it was his under- standing that a fire wall needed to be constructed between the two buildings on the south side which would involve his structure. APPROVAL Councilman Domenico moved that the Black Diamond Saloon's alteration request be approved. Seconded by Councilman Brown. Roll call vote: Fauson - Abstained DelPizzo Yes Meier Yes Brown Yes Domenico Yes Motion carried 4-0. WATER AGREEMENT Tabled.
