COUNCIL REMARKS Advised be would like to make a statemelt COUNCILMAN CUMMINGS in almnort of Mr. Biel 1 s by reminding Council re: r'.1 Superior Interchange, the 1500' setback, the Comp Plan - a Comp Plan that Council agreed to amend because it wasn't viable; and it was his opionion that Mt. Biella should not be put in the middle of various negotiations as it did not have anything to do with this annexation. He referred to section 16 - 32.22 of the Municipal Code states is to only consider if the petition meets the requirements of the law. It was his opinion this should be the main concern of council and not be influenced by talk of set-back, shopping center, or interchange. COUNCILMAN MEIER Remarked the annexation was not in th,. city's urban service area at this time, and this is in the process of being amended by DRCOG at the present time and the vote will be taken on this December 16, 1981 at their meeting. It was his opinion until the comp plan can be amended issues would have to be dealt with according to the ' present plan. He reminded Council of the Zurick annexation request that had been held up for sometime because the City felt there was an abundance of commercial zoning in the area and an office zoning was created. It was his opinion eat the situation has not changed for the need for additional com- mercial zoning. Councilman Meier inquired of Attorney Rautenstraus if the occasion arose where we had gone against. the comp plan as being open space would this jeopardize our position in the future. Attorney Rautenstraus advised it would depend on the individual case; however it is to the City's benefit if they have stuck with the comp plan if they are consistent - it may be different if they are not consistent.
