He <br /> referred to section 16 - 32.22 of the <br /> Municipal Code states is to only consider <br /> if the petition meets the requirements <br /> of the law. It was his opinion this should <br /> be the main concern of council and not be <br /> influenced by talk of set-back, shopping <br /> center, or interchange. <br /> COUNCILMAN MEIER Remarked the annexation was not in th,. <br /> city's urban service area at this time, <br /> and this is in the process of being amended <br /> by DRCOG at the present time and the vote <br /> will be taken on this December 16, 1981 <br /> at their meeting. It was his opinion until <br /> the comp plan can be amended issues would <br /> have to be dealt with according to the <br /> ' present plan. He reminded Council of the <br /> Zurick annexation request that had been <br /> held up for sometime because the City felt <br /> there was an abundance of commercial zoning <br /> in the area and an office zoning was created. <br /> It was his opinion eat the situation has <br /> not changed for the need for additional com- <br /> mercial zoning. <br /> Councilman Meier inquired of Attorney <br /> Rautenstraus if the occasion arose where <br /> we had gone against. the comp plan as being <br /> open space would this jeopardize our position <br /> in the future. <br /> Attorney Rautenstraus advised it would depend <br /> on the individual case; however it is to the <br /> City's benefit if they have stuck with the <br /> comp plan if they are consistent - it may <br /> be different if they are not consistent. <br />
