410 411 <br /> 6/15/82 Page 11 <br /> and shared parking would be provided if all <br /> other necessary parties agree thereon. <br /> Section 8. 6 of the described Subdivision <br /> Agreement should be amended as follows: <br /> 8.6 Subdivider agrees that they will supply <br /> a development plan for review and comment by <br /> the staff of the City within 30 days of the <br /> date of the Agreement for Phase 1 of con- <br /> struction. Furthermore, Subdivider agrees <br /> to a site review process under the Planned <br /> Unit Development procedures of the City, in- <br /> cluding landscaping plans , for an approval <br /> by the appropriate staff of the City, the <br /> Planning Commission of the City after a <br /> public hearing, and the City Council prior <br /> to the issuance of a building permit for <br /> additional construction on the property <br /> other than that provided in the Phase I <br /> Plans. In addition, Subdivider agrees <br /> to publish a notice of intent for such <br /> additional construction in the local <br /> newspaper of the City of Louisville. <br /> The Agreement concerning landscaping <br /> previously presented to the City by Nielsen <br /> should be amended as follows: <br /> A. Term two should read: Nielsen agrees <br /> it will spend $167 ,000.00 on landscaping <br /> on the subject property. Term three should <br /> be amended to state: Nielsen agrees to <br /> $post a performance bond in the amount of <br /> 208, 750.00 within ten days of this Agreement . <br /> B. If landscape improvements are not con- <br /> structed as set forth in Exhibit "1" of the <br /> Agreement concerning landscaping, the City <br /> shall have the right to make claim against <br /> the performance bond or any other security <br /> provided by Subdivider with respect to <br /> said landscape improvements and the City <br /> shall have the right to enter Subdivider's <br /> property to have said improvements constructed. <br /> That Subdivider agrees to implement and pub- <br /> licize a plan for a ride sharing or van pool- <br /> ing for its current employees and encourage <br /> participation of said employees in the pro- <br /> posed plan for the subject property and sub- <br /> mit a report to the City on the progress of <br /> said program prior to construction of the <br /> parking lot for the project for possible re- <br />
