6/13/82 Page -10- <br /> Charles Van DeBoogard Introduced himself and thanked council for <br /> 1400 Washington Ave. the opportunity to speak. It was his hope <br /> that the little phrase in the Louisville <br /> Times saying "it's your government was <br /> realistic. Mr. Van DeBoogard also felt <br /> that the Office zoning was not compatible <br /> with the residential subdivisions in the area. <br /> He too. felt that Council should consider <br /> the options offered by Mr. Knowlton - or <br /> not approve the subdivision plat at all. <br /> He felt that if Neodata relocated in the <br /> Industrial area they would have a beauti- <br /> ful aesthetic corridor entrance to the City. <br /> Expressed concern with the traffic impact <br /> and the huge parking lot. Asked Council <br /> to reassess if the proposal is in compli- <br /> ance with t..e office zoning; requested <br /> the subdivision plat be denied. <br /> A lengthy discussion followed by Council <br /> concerning independent appraisal of zoning. <br /> declaratory judgement, review of development <br /> plan by Council, change the amount of the <br /> landscaping plan to read $167,000. 00, ride- <br /> sharing and van pooling, heigth of buildings, <br /> agreement with Public Service. joint access <br /> and shared parking, and use of Security <br /> Guards for traffic control. <br /> CONDITIONS ADDED TO RESOLD- Councilwomen Morris moved, Councilman Cussen <br /> TION #22 seconded that conditions be added to <br /> Resolution #22 that Nielsen-Neodata enter <br /> into an agreement with the City setting <br /> forth the following conditions : <br /> Under Section 8.5 of the Subdivision Agreement <br /> entered into between the City and BSCS, the <br /> terms of which Nielsen shall assume upon pur- <br /> chase of subject property shall be amended to <br /> read as follows: If an agreement is reached <br /> with Public Service Company in conjunction <br /> with the City relative to use of the Public <br /> Service property located directly to the east <br /> of the Subdivider's property which allows <br /> for access to be provided to the subject <br /> property, Subdivider agrees to provide for <br /> joint access and shared parking. Said joint <br /> access and shared parking would be provided <br /> for Subdivider's property and the property <br /> developed by the Church of Jesus Christ of <br /> Latter Day Saints located to the east of <br /> subject property.
