Councilman Leary Commented his recollection of the shared access/shared parking was discussed with the Neodata people, and they stared if the LDS Chruch did not participate, Neodata would not . The discussion with the Church people was rather firm regarding reasonable efforts because we were not certain that Public Service would agree at that time. Commented that withholding a CO was not discussed at that time; but felt that all parties involved should make every reasonable effort to meet this condition. CO TO BE WITHHELD IF Councilman Leary moved, Councilwoman Morris SHARED ACCESS/SHARED PARKING seconded that a Certificate of Occupancy CONDITION IS NOT MET be withheld from the Church of the Latter Day Saints unless every reasonable effort is made with Neodata for shared access and shared parking. Attorney Rautenstraus Advised this may be premature since we have not received a written statement from Public Service; also what the responses are of the people involved. He stated that the Agree- ment should be enforced and perhaps the motion should be that the Agreement be enforced. Would not advise action of withholding some- thing because at present we do not have re- sponse from either Neodata, the LDS Church, or Public Service. He suggested holding off getting specific on the shared access/shared parking issuer until these responses are ob- tained. There would be time as he did not feel there would be any construction within the next two weeks. MOTION WITHDRAWN Councilman Leary Withdrew his motion and requested staff to make known to the parties involved that ne- gotiatinns continue and state the Council would likely 9ithhold CO' s if a good effort is not made. Councilwoman Morris Withdrew her second to the motion - expressed the same concerns as Councilman Leary, and wished clarification on Mayor Meier's position.
