Die not think this was <br /> appropriate. <br /> Councilman Leary Commented his recollection of the shared <br /> access/shared parking was discussed with <br /> the Neodata people, and they stared if the <br /> LDS Chruch did not participate, Neodata <br /> would not . The discussion with the Church <br /> people was rather firm regarding reasonable <br /> efforts because we were not certain that <br /> Public Service would agree at that time. <br /> Commented that withholding a CO was not <br /> discussed at that time; but felt that all <br /> parties involved should make every reasonable <br /> effort to meet this condition. <br /> CO TO BE WITHHELD IF Councilman Leary moved, Councilwoman Morris <br /> SHARED ACCESS/SHARED PARKING seconded that a Certificate of Occupancy <br /> CONDITION IS NOT MET be withheld from the Church of the Latter <br /> Day Saints unless every reasonable effort <br /> is made with Neodata for shared access and <br /> shared parking. <br /> Attorney Rautenstraus Advised this may be premature since we have <br /> not received a written statement from Public <br /> Service; also what the responses are of the <br /> people involved. He stated that the Agree- <br /> ment should be enforced and perhaps the motion <br /> should be that the Agreement be enforced. <br /> Would not advise action of withholding some- <br /> thing because at present we do not have re- <br /> sponse from either Neodata, the LDS Church, <br /> or Public Service. He suggested holding off <br /> getting specific on the shared access/shared <br /> parking issuer until these responses are ob- <br /> tained. There would be time as he did not <br /> feel there would be any construction within <br /> the next two weeks. <br /> MOTION WITHDRAWN <br /> Councilman Leary Withdrew his motion and requested staff to <br /> make known to the parties involved that ne- <br /> gotiatinns continue and state the Council <br /> would likely 9ithhold CO' s if a good effort <br /> is not made. <br /> Councilwoman Morris Withdrew her second to the motion - expressed <br /> the same concerns as Councilman Leary, and <br /> wished clarification on Mayor Meier's position. <br />
