8/2/83 Page -9- ADOPTION - RES. *26 Councilman Leary moved, Councilman Cussen seconded that Resolution *26 - Pine St. Plaza - Replat and P.U.D. be adopted. Question called for All in favor. Motion carried unanimously. WAREMBOURG ANNEXATION Attorney Rautenstraus advised that referendum REFERENDUM PETITION petitions with respect to Ordinance *791 - Warembourg Annexation were filed with the City within 30 days after final publication. The City Clerk had verified a sufficient number of signatures. Under State Statutes Council has the alternative to repeal the Ordinance or set an election. If it is set for an election it may be set at a regular or special election between 60 and 150 days from the date the petitions were filed. They were filed July 15 , 1983. The November Municipal Election does fit within those parameters. MOTION TO REPEAL ORDINANCE *791 Councilwoman Morris moved, Councilman Leary seconded that Ordinance 0791 - An Ordinance Annexing to the City of Louisville, Colorado, a Parcel of Approximately 91. 7 Acres Located West of Dutch Creek Subdivision and East of Heritage II Subdivision, Which is Owned by Kiubert Warembourg be repealed. Mayor Meier Commented at this time he would not necessarily Like to see this ordinance repealed but would rather it go to a vote of the people. Because a lot of discussion had been going on with councilmembers as far as the City's future growth and it was his feeling that this had already been presented as a slow growth type response to this annexation. He felt since it was already presented as such he thought it would almost behoove the City and Council to let the people vote on how they would like to have their growth and get that question answered once and for all. As it was presented, it was not the Warembourg annexation that we are opposing, we are opposing the fast growth then he felt that would answer the questions for the voting public, for Council and every- one else; then everyone can work off the same base. Rather than haveing it dropped at this time and trying to come up with something else as appropriate would just as well have it on the November ballot.
