110 410 <br /> 8/2/83 Page -12- <br /> ROLL CALL VOTE ON THE Roll call vote: <br /> MOTION TO REPEAL THE Meier Yes <br /> ORDINANCE Fauson No <br /> Leary Yes <br /> Morris Yes <br /> Cussen Yes <br /> Motion carried 4-1. <br /> CHURCH OF THE LATTER Attorney Rautenstraus advised that the <br /> DAY SAINTS - STREET street improvements have not been completed. <br /> IMPROVEMENTS Engineer Ken Huson has discussed the matter <br /> with representatives of the Ohurch and also <br /> with representatives of the company that <br /> have contracted to do the work. <br /> Ken Huson Act. City Engineer Advised that he had contacted the Inter- <br /> mountain Construction sub-contractor for <br /> the Morrnan Church to build the entire site <br /> and had been contacting him for the past <br /> 3-4 weeks, unable to get very far with them. <br /> Was informed yesterday that Intermountain <br /> has sub-contracted to Frontier Paving to do <br /> the street improvements and he assurred him <br /> that they would be doing that this week. <br /> Councilwoman Morris Stated the City should not wait any longer <br /> on the street improvements, they had ,been <br /> given ample notice several times - they <br /> promised to have them completed by August <br /> 2 , 1983 and felt that as a City should stand <br /> behind that commitment and take action on the <br /> Surety Bond and do what is necessary to <br /> complete the street improvement . <br /> Mayor Meier Concurred with Councilwoman Morris favoring <br /> the action on the Surety Bond and since the <br /> process would take 30 days approved of get- <br /> ting it initiated now. <br /> Councilman Cussen Commented he was at wits-end on the delay <br /> of the improvements and was weary with the <br /> many calls being received from the residents <br /> in the area. Reiterated that he feared that <br /> someone would be killed by driving into the <br /> hole. Felt that the Church people were being <br /> negligent by not putting more pressure on <br /> the contractors and be good neighbors with <br /> the City as promised. Suggested that as <br /> a City contact 2 or 3 companies - get some <br /> bids on the improvements and notify the <br /> Church people that the City will make the <br /> improvements and draw on the Surety Bond <br /> for payment . <br />
