• a . 8/2/83 Page --13- Attorney Rautenstraus suggested that Council direct staff take all actions necessary to get the street constructed as soon as possible and that would include the possibilities of any legal recourse or hiring any other con- tractors or doing whatever is necessary to get it completed. Councilman Leary Commented since the process will take 30 days is there a possibility of an emergency clause or that health and safety are really at stake. Attorney Rautenstraus stated contact could be made with the parties contracted with to do the work and make certain that they are doing it - would suggest a fairly broad motion on it pursuing all the basic options. Councilman Cussen Suggested to expedite the improvements rather than go through the bid process, the contractor used by Neodata be contacted for a price. Also expressed concern that the marked road appeared to worsen the situation with more of the street being torn up. Engineer Kuson explained that the old road is approximately 1' higher on grade than the designed grade which is put in for drainage purposes. Basically what was done in front of Neodata will be done in front of the Church. Half the street will be constructed to get it into proper design grade - this same process will take place on the remainder of the road. Assured Council that he would monitor this daily and make it as safe as possible. Councilwoman Morris Asked if the south side of South Boulder Road across from the Korman Church property could be filled so that there isn' t a large ditch at the edge. Administrator Wurl advised that the ditch was needed for drainage. Councilman Cussen requested that every avail- able avenue open to staff be pursued to waive the bid requirement & get the street improvements completed immediately. Felt that in view of safety all short cuts should be taken Requested that he be apprised byelaw what is happening and it be on the agenda for the next council meeting.
