• a . <br /> 8/2/83 Page --13- <br /> Attorney Rautenstraus suggested that Council <br /> direct staff take all actions necessary to <br /> get the street constructed as soon as possible <br /> and that would include the possibilities of <br /> any legal recourse or hiring any other con- <br /> tractors or doing whatever is necessary to <br /> get it completed. <br /> Councilman Leary Commented since the process will take 30 <br /> days is there a possibility of an emergency <br /> clause or that health and safety are really <br /> at stake. <br /> Attorney Rautenstraus stated contact could <br /> be made with the parties contracted with <br /> to do the work and make certain that they <br /> are doing it - would suggest a fairly broad <br /> motion on it pursuing all the basic options. <br /> Councilman Cussen Suggested to expedite the improvements rather <br /> than go through the bid process, the contractor <br /> used by Neodata be contacted for a price. <br /> Also expressed concern that the marked road <br /> appeared to worsen the situation with more <br /> of the street being torn up. <br /> Engineer Kuson explained that the old road is <br /> approximately 1' higher on grade than the <br /> designed grade which is put in for drainage <br /> purposes. Basically what was done in front <br /> of Neodata will be done in front of the Church. <br /> Half the street will be constructed to get it <br /> into proper design grade - this same process <br /> will take place on the remainder of the road. <br /> Assured Council that he would monitor this <br /> daily and make it as safe as possible. <br /> Councilwoman Morris Asked if the south side of South Boulder <br /> Road across from the Korman Church property <br /> could be filled so that there isn' t a large <br /> ditch at the edge. <br /> Administrator Wurl advised that the ditch <br /> was needed for drainage. <br /> Councilman Cussen requested that every avail- <br /> able avenue open to staff be pursued to <br /> waive the bid requirement & get the street <br /> improvements completed immediately. Felt <br /> that in view of safety all short cuts should <br /> be taken Requested that he be apprised byelaw <br /> what is happening and it be on the agenda <br /> for the next council meeting. <br />
