' Appall gave a short presentation and expressed <br /> Planning Commission's support of the annexation. <br /> Money in lieu of open space was part of the <br /> annexation agreement in the amount of 12Z of the <br /> appraised value. <br /> Historically, the Open Space Fund has been used to <br /> purchase and improve open space areas. Staff was <br /> asked to report beck to Council as to the exact <br /> fund that the money would be deposited from this <br /> annexation agreement. The City's Comprehensive <br /> Plan calls for a fund to be established with <br /> monies from annexation agreements. <br /> Mayor Meier closed the Public Hearing and moved <br /> that Ordinance 0853 be adopted. Cussen seconded <br /> and the motion was approved unanimously by roll <br /> call. <br /> ORDINANCE 0854 <br /> WINCHER ZONING <br /> PUBLIC HEARING Rautenstraus read Ordinance 0854," An Ordinance <br /> Amending Title 17 of the Louisville Municipal Code <br /> of the City of Louisville Entitled "Zoning" by <br /> Zoning Property of Approximately 9.9 Acres of <br /> Property Owned by John and Mary Wincher , Annexed <br /> to the City of Louisville by Ordinance No. 853." <br /> Rautenstraus stated that proper publication of the <br /> ordinance and notice of Public Hearing occurred in <br /> the Louisville Tines. <br /> Appell reviewed the ordinance for Council <br /> indicating that this is the first Business Office <br /> Zone that has come before staff. Stressed within <br /> this zone was "compatibility with residential area <br /> and no commercial uses more than 202 of the gross <br /> square footage." Both of these requirements have <br /> been met within this 9.9 acres. Staff and <br /> Planning Commission recommend this ordinance <br /> passed . <br /> Mayor Meier closed the Public Hearing and moved <br /> that Ordinance 0854 be adopted. Johnson seconded <br /> and the Ordinance was passed unanimously by roll <br /> call. <br /> METRO DENVER WATER <br /> AUTHORITY CONTRACT Hundley indicated that some people are still <br /> somewhat uncertain as to what participation in <br /> the Metro Denver Water Authority Contract would <br /> involve. He suggested that Noel Hobbs attend a <br /> Council Study Session on the 26th of February to <br /> further clarify both the short and long term <br /> obligation to the City of Louisville. <br /> 2 <br />
