3.0 Covenants and Promises. In consideration of the above cited premises and the hereinafter <br />mutual covenants and promises, the sufficiency of which is acknowledged, the parties agree as <br />follows: <br /> <br /> 3. :L Term. This Contract is expressly written for the November 6, 2001 Election and is <br />effective through December 31, 2001. <br /> <br /> 3.2 County Clerk Duties. The County Clerk shall perform the following duties for the <br />election for the City: <br /> <br /> (A) Notify the secretary, of s.tate, no later than fifty-five days prior to the election of the <br />intent to conduct the November 6, 2001 Coordinated Election as a mail ballot election. The <br />notification shall include a proposed plan for conducting the mail ballot election, which shall be <br />based on the standard plan adopted by the secretary of state. In accordance to 1-7.6-105, within <br />fifteen days, the secretary of state shall approve or disapprove of the written plan. <br /> <br /> (B) Contract with a reliable vendor to prepare and print the mail ballots; prepare a mail <br />ballot packet for each ACTIVE elector within the City of Louisville; address a mail ballot packet to <br />each ACTIVE elector within the City of Louisville; and mail the ballots between the twenty-fifth and <br />the fifteenth day before the election (October 12 and October 22, 2001) at the least cost. <br /> <br /> (C) Create the layout of the text of the ballot in a format that complies with Colorado <br />Election Law and is acceptable to the City. <br /> <br /> (D) In consultation with the City's Election Officer, the County Clerk will order the <br />number of ballots to be printed that could reasonably be expected to be mailed to each Active voter; <br />an adequate number of ballots to fill requests of Inactive Voters who, subsequent to the mailing of <br />ballots to all ACTIVE voters, present themselves to vote at the office of the County Clerk and <br />Recorder or apply for a Replacement ballot; and an adequate number of Duplication and test ballots. <br /> <br /> (E) Ensure that the ballots packets contain Instructions to the voters; a secrecy envelope <br />(if the type of ballot requires such envelope to maintain the privacy of the vote); an inner <br />verification/return envelope; and the outer/mail out envelope containing the appropriate postage, <br />Official Election Notice; and indicia for Return Service Requested. <br /> <br /> (F) <br />Package. <br /> <br />Determine the "least cost" method of preparing and mailing the TABOR Notice <br /> <br /> (G) If applicable, combine the text of the TABOR Notice submitted bythe City with those <br />of other jurisdictions to produce the TABOR Notice Package. The County Clerk may determine the <br />order of the TABOR Notice submitted by the City and those of other jurisdictions to be included in <br />the TABOR Notice Package provided, however, that the materials supplied by the City shall be kept <br />together as a ~oup and in the order supplied by the City. <br /> <br /> <br />
