<br /> ..,. <br /> Griffiths read by title only, Resolution #4, Series 1991, "A <br /> Resolution of the City Council of the City of Louisville finding <br /> substantial compliance of an annexation petition filed by Trinity <br /> Bible Evangelical Free Church, and initiating annexation <br /> proceedings for certain property and establishing a item for a <br /> public hearing to determine if the proposed annexation complies <br /> with statutory requirements." <br /> Franklin: Stated his presentation would include Item 5G <br /> and Item 5H. The property owner, Trinity <br /> Church, represented by Scott Carlson, has <br /> petitioned for annexation of 9.7 acres of <br /> land which is located at the south end of <br /> Main Street between Roosevelt and County Road <br /> (S. 96th Street). The proposed zoning is R-L <br /> and the applicant proposed to develop a <br /> single family detached residential <br /> subdivision. An annexation agreement is <br /> being prepared by the City and will be signed <br /> and submitted by the applicant prior to the <br /> public hearing. The agreement will include <br /> water rights, flood plain requirements and <br /> the vacation of the old railroad spur. <br /> Howard: I noticed that the only open space that is <br /> attached to this is a water detention lot, is <br /> there any other land put aside for this? <br /> Franklin: That was the original proposal. In the past <br /> the city has allowed combination drainage, <br /> park and open space areas. However, the <br /> annexation agreement is not complete and <br /> certainly the subdivision is not complete. <br /> One comment the staff did have that there was <br /> minimual amount of park land. This is an <br /> issue. <br /> Davidson: Our ordinance on the dedication of open space <br /> states that retention ponds and such <br /> shouldn't be considered as open space. I <br /> think this was a well written ordinance and <br /> we should follow it. Also I would like to <br /> see by the time the public hearing is in <br /> place your view of ways to permit having 10 <br /> acres coming in or are there other ways to <br /> look at this. <br /> Franklin explained that from a planning point of view this is <br /> very difficult to do. <br /> Howard moved to adopt Resolution #4, Series 1991 and also have <br /> the owner be made aware that the open space dedication issue has <br /> come up so that it can be taken care of before it gets back to <br /> Council, seconded by Mayor Fauson.
