It is a requirement to take medicated <br />action if you are building in a floodplain to <br />prevent additional water from effecting the <br />surrounding residents. What action is going to be <br />taken? <br /> <br />Franklin: The agreement speaks to the issue of floodplain at <br />this level of annexation and zoning, which is <br />quite a bit prior to development. The owners <br />acknowledges that he will have to abide by the <br />floodplain regulations of the city of Louisville <br />prior to development. That will entail <br />engineering studies prior to the development based <br />on the limitation and/or restrictions of the <br />floodplain regulations and/or his development <br />economics. At this level, we do not have a formal <br />subdivision request. <br /> <br />Davidson: 17.56.160 in the flood plain regulations R-L is <br />not a permitted zoning. How do you propose for us <br />to zone this R-L? <br /> <br />Franklin: I did not understand that provision to exclude <br />zoning of property, but rather residential <br />development. <br /> <br />Davidson: If sections A, Band C are read, it tells you what <br />zonings are allowed. Nowhere in there is <br />residential mentioned. <br /> <br />Franklin: Those are uses. Zoning is established through the <br />zoning regulations and the use of the ground in <br />the flood plain is established through the flood <br />plain requirements subject to approval of the <br />Board of Adjustments. If zoning is approved for <br />this property the use of the ground is restricted <br />by the flood plain regulations until some time <br />that the owner of the ground is able to prove <br />satisfactorily to the City that the property that <br />is currently within the flood plain can be filled <br />or developed for residential purposes. <br /> <br />Davidson: Asked the City Attorney if we annex this property <br />and zone it R-L, even though the allowed uses are <br />not residential, do we have a conflict? Can we <br />annex and zone it R-L then tell the owner he can't <br />use it for what it is zoned for? <br /> <br />Griffiths: Is the entire area within the flood plain or just <br />a portion of the area in the flood plain? <br /> <br />Franklin: I believe according to a map I have received, that <br /> <br /> <br />11 <br />
