<br />..1.1 <br /> <br /> <br /> <br /> <br /> <br />RESOLUTION NO.9, SERIES 1991 - CARLSON ANNEXATION <br /> <br />Griffiths read by title only Resolution No.9, Series 1991, "A <br />Resolution to the Annexation of certain real property located at <br />the South end of Main Street between Roosevelt Avenue and County <br />Road (S. 96th Street), owned by Trinity Bible Evangelical Free <br />Church." <br /> <br />Franklin requested Items 5E, 5F, and 5G be a single public <br />hearing and that the three items be considered thereafter. <br /> <br />Franklin: The request before you tonight and the purpose of <br />the hearing is for annexation and for R-L zoning <br />of 9.7 acres of land located generally at the <br />South end of Main Street and between Roosevelt <br />Avenue and County Road (S. 96th st). The property <br />owner is Trinity Bible Evangelical Free Church and <br />they have submitted a petition for annexation and <br />zoning request. The proposed zoning is for R-L <br />(Residential Low Density), which would permit <br />development of single family detached residential. <br />An annexation agreement draft is included in the <br />packet. The City Attorney and I have discussed <br />the status of the annexation agreement and I <br />believe that the annexation and the zoning should <br />not be consummated after your vote until or unless <br />the agreement is signed. On page three of the <br />annexation agreement; item 14 special provisions <br />there are four special provisions: Flood plain, <br />Coal Creek Trail temporary by-pass, the old <br />railroad right-of-way and thoroughfare planning <br />for the area. These items have been discussed <br />with the owners. <br /> <br />Davidson: On page two of the agreement it talks about the <br />ditch being excluded from dedication to the city, <br />when section 16.32.030 section (g) of the <br />Ordinance requires dedication of water rights <br />associated with the land. Why was it excluded? <br /> <br />Franklin: The part of the agreement may not be applicable to <br />the property in that the property does not have <br />water rights that joins with it and therefore <br />would be residential zoned subject to the <br />Resolution No. 52. <br /> <br />Scott Carlson, representing Trinity Bible Evangelical Free Church <br /> <br />Carlson: It is my understanding that if there are water <br />rights associated with the property, then those <br />water rights must be sold or dedicated to the <br />city. There are no water rights associated with <br />this property, so when the development occurs we <br />would have to pay an additional water resource <br /> <br /> <br />10 <br />
